Continuing my exploration of the Constitution and what it says about Assassinations

I have established previously that the Constitution is sole source of ANY and ALL Federal powers. It might be worth examining therefore what was said about "terrorists" at the time of ratification by those men many here claim they admire:the Founding Fathers. In a contentious rebuke to Patrick Henry's claim that VA was at peace and did not need a new government, VA Governor Edmond Randolph rose to spin a tale of how Mr. Henry's government of VA had pursued and executed a known terrorist. This is illuminating because Randolph is arguing FOR ratification to ostensibly STOP future Josiah Phillips' cases from happening.
"There is one example of this violation in Virginia, of a most striking and shocking nature — an example so horrid, that, if I conceived my country would passively permit a repetition of it, dear as it is to me, I would seek means of expatriating myself from it. A man, who was then a citizen, was deprived of his life thus: from a mere reliance on general reports, a gentleman in the House of Delegates informed the house, that a certain man (Josiah Philips) had committed several crimes, and was running at large, perpetrating other crimes. He therefore moved for leave to attain him; he obtained that leave instantly; no sooner did he obtain it, than he drew from his pocket a bill ready written for that effect; it was read three times in one day, and carried to the Senate. I will not say that it passed the same day through the Senate; but he was attained very speedily and precipitately, without any proof better than vague reports. Without being confronted with his accusers and witnesses, without the privilege of calling for evidence in his behalf, he was sentenced to death, and was afterwards actually executed. Was this arbitrary deprivation of life, the dearest gift of God to man, consistent with the genius of a republican government? Is this compatible with the spirit of freedom? This, sir, has made the deepest impression on my heart, and I cannot contemplate it without horror. There are still a multiplicity of complaints of the debility of the laws. Justice, in many instances, is so unattainable that commerce may, in fact, be said to be stopped entirely. There is no peace, sir, in this land. Can peace exist with injustice, licentiousness, insecurity, and oppression? These considerations, independent of many others which I have not yet enumerated, would be a sufficient reason for the adoption of this Constitution, because it secures the liberty of the citizen, his person and property, and will invigorate and restore commerce and industry. An additional reason to induce us to adopt it is that excessive licentiousness which has resulted from the relaxation of our laws, and which will be checked by this government. Let us judge from the fate of more ancient nations: licentiousness has produced tyranny among many of them: it has contributed as much (if not more) as any other cause whatsoever to the loss of their liberties. I have respect for the integrity of our legislatures; I believe them to be virtuous; but as long as the defects of the Constitution exist, so long will laws be imperfect."

Mr. Madison then rose to respond to Randolph, note his devotion to due process and execution of laws. See if it sounds like Madison is a fan of our current drone assassinations of American Citizens and bear in mind that Madison wants this system - The Constitution - to PREVENT these injuries to liberty.
"(Mr. Henry.) He told us that this Constitution ought to be rejected because it endangered the public liberty, in his opinion, in many instances. Give me leave to make one answer to that observation: Let the dangers which this system is supposed to be replete with be clearly pointed out: if any dangerous and unnecessary powers be given to the general legislature, let them be plainly demonstrated; and let us not rest satisfied with general assertions of danger, without examination. If powers be necessary, apparent danger is not a sufficient reason against conceding them. He has suggested that licentiousness has seldom produced the loss of liberty; but that the tyranny of rulers has almost always effected it. Since the general civilization of mankind, I believe there are more instances of the abridgment of the freedom of the people by gradual and silent encroachments of those in power, than by violent and sudden usurpations; but, on a candid examination of history, we shall find that turbulence, violence, and abuse of power, by the majority trampling on the rights of the minority, have produced factions and commotions, which, in republics, have, more frequently than any other cause, produced despotism. If we go over the whole history of ancient and modern republics, we shall find their destruction to have generally resulted from those causes. If we consider the peculiar situation of the United States, and what are the sources of that diversity of sentiment which pervades its inhabitants, we shall find great danger to fear that the same causes may terminate here in the same fatal effects which they produced in those republics. This danger ought to be wisely guarded against. Perhaps, in the progress of this discussion, it will appear that the only possible remedy for those evils, and means of preserving and protecting the principles of republicanism, will be found in that very system which is now exclaimed against as the parent of oppression."

And now for the final piece of the puzzle, and remember, we are exploring this killing and its legality or sanction under the Constitution. Now witness Patrick Henry's response to Randolph and Madison. Henry is arguing AGINST ratification and defends the Obama style execution for crimes against humanity.
"The honorable member has given you an elaborate account of what he judges tyrannical legislation, and an ex post facto law, (in the case of Josiah Philips.) He has misrepresented the facts. That man was not executed by a tyrannical stroke of power. Nor was he a Socrates. He was a fugitive murderer and an outlaw — a man who commanded an infamous banditti, and at a time when the war was at the most perilous stage. He committed the most cruel and shocking barbarities. He was an enemy to the human name. Those who declare war against the human race may be struck out of existence as soon as they are apprehended. He was not executed according to those beautiful legal ceremonies which are pointed out by the laws in criminal cases. The enormity of his crimes did not entitle him to it. I am truly a friend to legal forms and methods; but, sir, the occasion warranted the measure. A pirate, an outlaw, or a common enemy to all mankind, may be put to death at any time. It is justified by the laws of nature and nations."

Say what you may, but this man has a point!!!

Adams wrote this letter to Declaration of Independence signer William Hooper of North Carolina. He also transcribed this out by hand to William Penn and R.H. Lee of Virginia. Lee would circulate the contents and ideas among his peers in Virginia. These ideas helped form the foundation for Virginia’s first Constitution which was written and signed into law in June of 1776- weeks before the rest of the colonies would join the Virginians in declaring Independence. - Mike Church

MY DEAR SIR,--If I was equal to the task of forming a plan for the government of a colony, I should be flattered with your request, and very happy to comply with it; because, as the divine science of politics is the science of social happiness, and the blessings of society depend entirely on the constitutions of government, which are generally institutions that last for many generations, there can be no employment more agreeable to a benevolent mind than a research after the best.

Pope flattered tyrants too much when he said,

"For forms of government let fools contest,

That which is best administered is best."

Nothing can be more fallacious than this. But poets read history to collect flowers, not fruits; they attend to fanciful images, not the effects of social institutions. Nothing is more certain, from the history of nations and nature of man, than that some forms of government are better fitted for being well administered than others.

We ought to consider what is the end of government, before we determine which is the best form. Upon this point all speculative politicians will agree, that the happiness of society is the end of government, as all divines and moral philosophers will agree that the happiness of the individual is the end of man. From this principle it will follow, that the form of government which communicates ease, comfort, security, or, in one word, happiness, to the greatest number of persons, and in the greatest degree, is the best.

All sober inquirers after truth, ancient and modern, pagan and Christian, have declared that the happiness of man, as well as his dignity, consists in virtue. Confucius, Zoroaster, Socrates, Mahomet, not to mention authorities really sacred, have agreed in this.

If there is a form of government, then, whose principle and foundation is virtue, will not every sober man acknowledge it better calculated to promote the general happiness than any other form?

Fear is the foundation of most governments; but it is so sordid and brutal a passion, and renders men in whose breasts it predominates so stupid and miserable, that Americans will not be likely to approve of any political institution which is founded on it.

Honor is truly sacred, but holds a lower rank in the scale of moral excellence than virtue. Indeed, the former is but a part of the latter, and consequently has not equal pretensions to support a frame of government productive of human happiness.

The foundation of every government is some principle or passion in the minds of the people. The noblest principles and most generous affections in our nature, then, have the fairest chance to support the noblest and most generous models of government.

A man must be indifferent to the sneers of modern English men, to mention in their company the names of Sidney, Harrington, Locke, Milton, Nedham, Neville, Burnet, and Hoadly. No small fortitude is necessary to confess that one has read them. The wretched condition of this country, however, for ten or fifteen years past, has frequently reminded me of their principles and reasonings. They will convince any candid mind, that there is no good government but what is republican. That the only valuable part of the British constitution is so; because the very definition of a republic is "an empire of laws, and not of men." That, as a republic is the best of governments, so that particular arrangement of the powers of society, or, in other words, that form of government which is best contrived to secure an impartial and exact execution of the laws, is the best of republics.

Of republics there is an inexhaustible variety, because the possible combinations of the powers of society are capable of innumerable variations.

As good government is an empire of laws, how shall your laws be made? In a large society, inhabiting an extensive country, it is impossible that the whole should assemble to make laws. The first necessary step, then, is to depute power from the many to a few of the most wise and good. But by what rules shall you choose your representatives? Agree upon the number and qualifications of persons who shall have the benefit of choosing, or annex this privilege to the inhabitants of a certain extent of ground.

The principal difficulty lies, and the greatest care should be employed, in constituting this representative assembly. It should be in miniature an exact portrait of the people at large. It should think, feel, reason, and act like them. That it may be the interest of this assembly to do strict justice at all times, it should be an equal representation, or, in other words, equal interests among the people should have equal interests in it. Great care should be taken to effect this, and to prevent unfair, partial, and corrupt elections. Such regulations, however, may be better made in times of greater tranquillity than the present; and they will spring up themselves naturally, when all the powers of government come to be in the hands of the people's friends. At present, it will be safest to proceed in all established modes, to which the people have been familiarized by habit.

A representation of the people in one assembly being obtained, a question arises, whether all the powers of government, legislative, executive, and judicial, shall be left in this body? I think a people cannot be long free, nor ever happy, whose government is in one assembly. My reasons for this opinion are as follow:--

1. A single assembly is liable to all the vices, follies, and frailties of an individual; subject to fits of humor, starts of passion, flights of enthusiasm, partialities, or prejudice, and consequently productive of hasty results and absurd judgments. And all these errors ought to be corrected and defects supplied by some controlling power.

3. A single assembly is apt to grow ambitious, and after a time will not hesitate to vote itself perpetual. This was one fault of the Long Parliament; but more remarkably of Holland, whose assembly first voted themselves from annual to septennial, then for life, and after a course of years, that all vacancies happening by death or otherwise, should be filled by themselves, without any application to constituents at all.

4. A representative assembly, although extremely well qualified, and absolutely necessary, as a branch of the legislative, is unfit to exercise the executive power, for want of two essential properties, secrecy and despatch.

5. A representative assembly is still less qualified for the judicial power, because it is too numerous, too slow, and too little skilled in the laws.

6. Because a single assembly, possessed of all the powers of government, would make arbitrary laws for their own interest, execute all laws arbitrarily for their own interest, and adjudge all controversies in their own favor.

But shall the whole power of legislation rest in one assembly? Most of the foregoing reasons apply equally to prove that the legislative power ought to be more complex; to which we may add, that if the legislative power is wholly in one assembly, and the executive in another, or in a single person, these two powers will oppose and encroach upon each other, until the contest shall end in war, and the whole power, legislative and executive, be usurped by the strongest.

The judicial power, in such case, could not mediate, or hold the balance between the two contending powers, because the legislative would undermine it. And this shows the necessity, too, of giving the executive power a negative upon the legislative, otherwise this will be continually encroaching upon that.

To avoid these dangers, let a distinct assembly be constituted, as a mediator between the two extreme branches of the legislature, that which represents the people, and that which is vested with the executive power.

Let the representative assembly then elect by ballot, from among themselves or their constituents, or both, a distinct assembly, which, for the sake of perspicuity, we will call a council. It may consist of any number you please, say twenty or thirty, and should have a free and independent exercise of its judgment, and consequently a negative voice in the legislature.

These two bodies, thus constituted, and made integral parts of the legislature, let them unite, and by joint ballot choose a governor, who, after being stripped of most of those badges of domination, called prerogatives, should have a free and independent exercise of his judgment, and be made also an integral part of the legislature. This, I know, is liable to objections; and, if you please, you may make him only president of the council, as in Connecticut. But as the governor is to be invested with the executive power, with consent of council, I think he ought to have a negative upon the legislative. If he is annually elective, as he ought to be, he will always have so much reverence and affection for the people, their representatives and counsellors, that, although you give him an independent exercise of his judgment, he will seldom use it in opposition to the two houses, except in cases the public utility of which would be conspicuous; and some such cases would happen.

In the present exigency of American affairs, when, by an act of Parliament, we are put out of the royal protection, and consequently discharged from our allegiance, and it has become necessary to assume government for our immediate security, the governor, lieutenant-governor, secretary, treasurer, commissary, attorney-general, should be chosen by joint ballot of both houses. And these and all other elections, especially of representatives and counsellors, should be annual, there not being in the whole circle of the sciences a maxim more infallible than this, "where annual elections end, there slavery begins."

These great men, in this respect, should be, once a year,

"Like bubbles on the sea of matter borne, They rise, they break, and to that sea return."

This will teach them the great political virtues of humility, patience, and moderation, without which every man in power becomes a ravenous beast of prey.

This mode of constituting the great offices of state will answer very well for the present; but if by experiment it should be found inconvenient, the legislature may, at its leisure, devise other methods of creating them, by elections of the people at large, as in Connecticut, or it may enlarge the term for which they shall be chosen to seven years, or three years, or for life, or make any other alterations which the society shall find productive of its ease, its safety, its freedom, or, in one word, its happiness.

A rotation of all offices, as well as of representatives and counsellors, has many advocates, and is contended for with many plausible arguments. It would be attended, no doubt, with many advantages; and if the society has a sufficient number of suitable characters to supply the great number of vacancies which would be made by such a rotation, I can see no objection to it. These persons may be allowed to serve for three years, and then be excluded three years, or for any longer or shorter term.

Any seven or nine of the legislative council may be made a quorum, for doing business as a privy council, to advise the governor in the exercise of the executive branch of power, and in all acts of state.

The governor should have the command of the militia and of all your armies. The power of pardons should be with the governor and council.

Judges, justices, and all other officers, civil and military, should be nominated and appointed by the governor, with the advice and consent of council, unless you choose to have a government more popular; if you do, all officers, civil and military, may be chosen by joint ballot of both houses; or, in order to preserve the independence and importance of each house, by ballot of one house, concurred in by the other. Sheriffs should be chosen by the freeholders of counties; so should registers of deeds and clerks of counties.

All officers should have commissions, under the hand of the governor and seal of the colony.

The dignity and stability of government in all its branches, the morals of the people, and every blessing of society depend so much upon an upright and skillful administration of justice, that the judicial power ought to be distinct from both the legislative and executive, and independent upon both, that so it may be a check upon both, as both should be checks upon that. The judges, therefore, should be always men of learning and experience in the laws, of exemplary morals, great patience, calmness, coolness, and attention. Their minds should not be distracted with jarring interests; they should not be dependent upon any man, or body of men. To these ends, they should hold estates for life in their offices; or, in other words, their commissions should be during good behavior, and their salaries ascertained and established by law. For misbehavior, the grand inquest of the colony, the house of representatives, should impeach them before the governor and council, where they should have time and opportunity to make their defence; but, if convicted, should be removed from their offices, and subjected to such other punishment as shall be thought proper.

A militia law, requiring all men, or with very few exceptions besides cases of conscience, to be provided with arms and ammunition, to be trained at certain seasons; and requiring counties, towns, or other small districts, to be provided with public stocks of ammunition and entrenching utensils, and with some settled plans for transporting provisions after the militia, when marched to defend their country against sudden invasions; and requiring certain districts to be provided with field-pieces, companies of matrosses, and perhaps some regiments of light-horse, is always a wise institution, and, in the present circumstances of our country, indispensable.

Laws for the liberal education of youth, especially of the lower class of people, are so extremely wise and useful, that, to a humane and generous mind, no expense for this purpose would be thought extravagant.

The very mention of sumptuary laws will excite a smile. Whether our countrymen have wisdom and virtue enough to submit to them, I know not; but the happiness of the people might be greatly promoted by them, and a revenue saved sufficient to carry on this war forever. Frugality is a great revenue, besides curing us of vanities, levities, and fopperies, which are real antidotes to all great, manly, and warlike virtues.

But must not all commissions run in the name of a king? No. Why may they not as well run thus, "The colony of to A. B. greeting," and be tested by the governor?

Why may not writs, instead of running in the name of the king, run thus, "The colony of to the sheriff," &c., and be tested by the chief justice?

Why may not indictments conclude, "against the peace of the colony of and the dignity of the same?"

A constitution founded on these principles introduces know ledge among the people, and inspires them with a conscious dignity becoming freemen; a general emulation takes place, which causes good humor, sociability, good manners, and good morals to be general. That elevation of sentiment inspired by such a government, makes the common people brave and enterprising. That ambition which is inspired by it makes them sober, industrious, and frugal. You will find among them some elegance, perhaps, but more solidity; a little pleasure, but a great deal of business; some politeness, but more civility. If you compare such a country with the regions of domination, whether monarchical or aristocratical, you will fancy yourself in Arcadia or Elysium.

If the colonies should assume governments separately, they should be left entirely to their own choice of the forms; and if a continental constitution should be formed, it should be a congress, containing a fair and adequate representation of the colonies, and its authority should sacredly be confined to these cases, namely, war, trade, disputes between colony and colony, the post office, and the unappropriated lands of the crown, as they used to be called.

These colonies, under such forms of government, and in such a union, would be unconquerable by all the monarchies of Europe.

You and I, my dear friend, have been sent into life at a time when the greatest lawgivers of antiquity would have wished to live. How few of the human race have ever enjoyed an opportunity of making an election of government, more than of air, soil, or climate, for themselves or their children! When, before the present epocha, had three millions of people full power and a fair opportunity to form and establish the wisest and happiest government that human wisdom can contrive? I hope you will avail yourself and your country of that extensive learning and indefatigable industry which you possess, to assist her in the formation of the happiest governments and the best character of a great people. For myself, I must beg you to keep my name out of sight; for this feeble attempt, if it should be known to be mine, would oblige me to apply to myself those lines of the immortal John Milton, in one of his sonnets:--

"I did but prompt the age to quit their clogs

By the known rules of ancient liberty,

When straight a barbarous noise environs me

Of owls and cuckoos, asses, apes, and dogs."

The south declared their independence from the northern aggressors on this date. The bullshit slavery arguement is just that and is null and void here so skip it. The Corwin amendment Lincoln offered the south or "cotton states" proves the slavery bullshit.
My question to you is the 14th amendment constitutional? Think hard about it before you just throw something out there!
I will give you a hint: RATIFICATION
If the southern states where considered the enemy and war was waged as such. If the north blockcade of southern ports (that the Constitution deems as war). And after the war the southern states sent their representatives to Washington (the north's representatives refused to seat them) then ratification could not have been complete without a united count.
So I ask you again, is the 14th amendment constitutional?

Hello friends. I have been very busy with a house remodel. Started with a antique piece for the bathroom my wife wanted and expanded to redo of bathroom. Other bathroom had to be done first to have a place to go, well you know (still isn't finished). So after floor joist replacing due to water rot over a hundred years, floor leveling and re-plumbing of entire house, I'm just getting started. Yes all done by meself. Work, well that is still a four letter word. My garden is in. Thirty two yards of moo poo (manure, compost and loam) hauled in. Thank God above I have a skid loader!

As the title of this post states history repeating itself, well it does. The left, tweekers that they are, never sleeps. The right never wakes. One side delivers higher taxes and war, the other higher taxes and war. After tuesday's senate vote on the proposal by Rand that passed 90 - 10 on a general constitutional question, I realized the Constitution is dead. No burial services were needed, it has been cremated.
I say this with a heavy heart because I now understand our system of gubbermint. A Monarchy with a house of Lords. We are just serfs, you know the proverbial "little people". Nothing will change unless we are violent. Please understand and know that isn't what I want. But the ten red sq. mile in DC isn't about to change, it is what it is. And we are who we are, a people who have been conquered by it. Like a junkie to a dealer, we are enslaved to our addiction of entitlements. Parasites!
I have read a lot of books this year alone, most are re-reads. The Fountainhead by Ayn Rand I found a little comfort in. The courtroom great speech given by Howard Roark still holds true today, I think more than ever now is it's time to be reborn.

I was watching the the train wreck that calls itself news this morning. Meridath Vieira was explaining that one of the reasons of the soaring gas prices was because of the economy improving. Really --- I mean REALLY! Do you think this is correct? Is the price of food and clothing going down, leaving you with the extra money in your pocket to spend it on gas? Did you get more money back from the IRS? Did your interest rate on your credit cards go down? Did the parasitic class stop taken welfare? Did the Gubbermint stop consuming your wage? Did Obama care fund itself (thru taxes) and the act of repeal and defunding it is pure follie? Well the last one did happen....
Then Matt Liar Lauer asked a "true"(HA) conservative, Rick Santorum if a Presidential run was in the wings. Lauer claimed the 'polled' country doesn't care about "social" issues, that the economy is item one. Santorim gave the standard response but defended his values of social issues, to his credit. But Conservative --NO.
Look we are screwed but the true conservative thing to do is stop meddling in foreign affairs, securing our borders with something more than bean bags. Full automatic weapons, air support and our National Guard comes to mind. And ending the only foreign import we actually need. Extracting LP and oil from within our shores and borders, building refineries that in turn renews the "steel mill" cities of the northeast. Research and development of new methods of energy. Expanding that European model - of Nukes. All of which creating jobs by the private sector. NOT THE GUBBERMINT. And tell the world --- NO MORE AID! None zilch, el zippo!,
I honestly believe the Union called the United States of America is over and a Confederation of States will prevail. Meaning a secession of states will create their own smaller countries and adopting new Constitutions. They will unite only in military issues that concern the Confederation's defence from foreign invasion or true threat and trade agreements. Think that I have read this somewhere. I know where!
But the notion that we live in free states is a illusion destroyed by Republicans and Democrats and most importantly - us the people. We allowed it to happen. We did not even attempt to defend our country as our founders did. We gave it away without a shot being fired. We let the "Useful Idiots" lull us into lies.

Sharky went to me local bookstore today to get me a new read. I noticed it was very busy in the parking lot and there was a huge bus parked outside the place. Inside the store and wrapping around the isles were throngs of folks lined up. Book signing I reckon. Got my book, paid for it and headed for the exit. The doors where occupied by managers and they were opening them for me, I thought. So as I approached them my eyes were focused on the man holding one of them and saying 'thanks' to him. Well, I walked right into the guest. Damned near bumped heads we did.
We both took a step back asked forgiveness. Guess who, none other than Prez hopeful Mike Huckabee. Yep eye to eye with the Gov. himself. He is a extremely nice man and asked if I was there for his book. Nope I said and showed the copy of Rollback by Thomas Woods, he said "good book" and then he asked the question. My reply - 'well if you had dropped out of the race last time, the idiot in charge would be named Romney not Obama and that's just unforgivable.'

He shook my hand and walked on. Guess he took that as a no. And he'd be right!

As some of you know, we're in the middle of a global warming heat wave her in Texas. It is so severe that I think it has gone all the way around the thermometer and starting over at the bottom end of the scale. So I braved the heat and tropic moisture and headed to town to get supplies. As this picture illustrates the roads were treacherous due to all the run off of dry white sand that would melt tongues to metal poles!

Upon getting to the Wally World I soon discovered Egg laying must cease during these hot spells. The liqueur store had the same problem but I managed to salvage the trip by finding the only two bottles of Crown Reserve they had!

Note to self :

Remember to close door and roll up window to keep falling White sand out of wife's Suburban! Maybe it will ~~thaw~~, Blow out by next Tuesday, MAYBE.

A bunch of folks can't understand how we came to have an oil shortage here in our country. Well there is a very simple answer. Nobody bothered to check the oil. We didn't know we were getting low!
The reason for that is purely geographical. Our oil is located in Alaska, California, Coastal Florida, Coastal Louisianna, Kansas, Pennsylvania, Oklahoma and my beloved Texas.
The problem is our DIPSTICKS are located in Washington DC!

No evidence is pushing upon my witnesses, GPS, call records, vendors, yet having to prove innocence in a world of guilty until prove yourself, not innocent, but UN-guilty. When asked if their proof is acceptable in their eyes to bare it's weight in court of law, is when I saw the "Welcome to Libtardia" light come on. As ol' Wyatt Earp (Kurt Russell) said, "You called for the thunder, well I'm coming and Hell's coming with me!" Will keep ya abreast of.

On to the duck and dive, rope-a-dope, Obama/Biden 2012 run for office kick-off tonight! The State of Our Dis-Union
Presenter- Mike Church

My fellow citizens of These United States, little r republicans and admirers of those men known as the Founding Fathers. I come before you tonight to report on the state of our union and unlike the past occupants of the office of President I will present to you an accurate, honest accounting on the actual condition of our affairs, not what I would like for you to believe they are.

First let’s go over some vocabulary we’ll be using tonight that you may not be familiar with starting with The Constitution. The Constitution Is what’s contained in this pocket sized book. Inside it you will find a plan of government, our government. It means what the men who wrote and ratified it said that it meant to them not what you would like it to mean today. If you are unhappy that this document places restrictions on what you would like our federal government to do for you or to another citizen then please read Article V of this Constitution, there you will find instructions on how to amend the document so that it rises to your expectations.

Our Second vocabulary word is Entitlement: If I have earned a sum of money and I deposit it in a safe in my home, I am ENTITLED to retrieve it and spend it as I choose. In contrast, my next door neighbor or a citizen in the next state is NOT entitled to what is contained in my safe to spend as they choose. If my neighbors aren’t entitled to my safe’s contents then why is my Congressman or my Governor or my mayor? They believe they are because they have ignored the Constitution I spoke of earlier and have created government programs like Social Security, Medicare, Medicaid and SCHIP to name a few. Those that enroll in these programs are told they are entitled to what is contained in my safe to fund them, they are wrong and tonight I shall call on you to end this practice and to star calling these programs by what they actually are executing: Legal Plunder. You may also call this theft at the point of the IRS gun.

This brings us to Vocabulary words 4 and 5: Property and Plunder. Property is what is owned outright by a citizen in a free society. Governments are instituted by free men to protect their private property from those who would plunder it. Plunder is the theft of another man’s property with the intention of making it your property. Plunder will always be the preferred method of acquiring property by lazy, designing men and women. Our Constitution and the state governments created and organized by their Constitutions were designed by men who wanted to protect their private property from plunder. Today, at every level of government this formula is now exactly backwards. Governments are organized to execute the plunder safely for the ruling class that doesn’t have the courage to perform the task themselves. The great French philosopher Frederic Bastiat wrote that “men will always choose plunder over profit so long as it is safe and not dangerous to their health” well tonight I call on you to serve notice to the plunderers: plunder just became a very dangerous occupation.

Our governments have created many classes of plunderers and they aren’t all of the direct public assistance variety. They are outnumbered by those plunderers in big business who have decided that buying favor with politicians by funding their campaigns and employing their family and friends in return for subsidies and regulations that punish their competitors is preferable to earning profits the old fashioned way. Plunder also comes in the form of those now infamous bailouts which most of you think have ended…they haven’t. Plunderers can also be found working at expert centers across the country where the rules that government makes are studied to measure their impact and then recommend new rules be made that will require new institutions to study them. And then there are institutions studying institutions and you fellow citizen are paying for every paper they write, pixel they push and paper clip they buy. Plunderers have also set up camp and enlisted tens of thousands of our former military, trained at our expense and now working to keep unneeded and unnecessary weaponry cranking out 24/7. It’s nice work if you can find it and it needs to end because we are broke. In the words of Bill Clinton “It is time to make government plunder unsafe, illegal and rare.”

Tonight, we must commit to begin anew the restoration of virtue and humility in our public affairs. In doing so we will return to our republican roots and I mean to say our “little r-republican roots” and that is our final vocabulary word. Republicanism. Republicanism is the political system that our Founders organized under and can best be defined by citing an obscure statistic. In 1945, young men who returned home from World War II could have formed families and then enlisted to participate in the governing of their local schools. This young man would have had over 115,000 positions to choose from. In a mere 60 years a young woman returning from an undeclared war in Pakistan may choose to start a family and participate in governing her local school only to find it isn’t local any longer and there are less than 13,000 positions available. Republicanism has given way to what our Founders feared more mightily than any Army clad in Red coats or any Tax Act passed by parliament: Consolidation.

Here is what this consolidation of government, which was the design of last centuries “progressives”, who occupied office in both major political parties, has produced: A Federal Leviathan that consumes 24% of every dollar earned in this country. This does not include the unfunded - future liabilities- that are owed as part of the entitlements discussed earlier. In contrast, this same federal government, limited by the restraints the Constitution and fidelity to republicanism placed on it, spent on average no less than 3% of GDP. During this time, our economic liberty, lack of organized plunder and protection of private property produced improvements in the quality of life and life expectancy so unprecedented, new words had to be created to describe them as new devices and compounds were created to continue the improvements. What has truly been lost though cannot be measured in dollars and cents but can be measured in part by the faces of beautiful children who will never know what a father is. At the dawn of the Progressive’s Great Society a shocking amount of black children were born out of wedlock. That shocking number then was 38% after Tens of Trillions in direct wealth transfers and the destruction of inner city families brought on by Progressive initiatives that number is now 70% and I challenge the good people of these United States to coin a term that adequately describes this uniquely American tragedy.

As if this tragedy weren’t enough to ring every fire house bell in the land consider that the rate of illegitimate children born to white, unwed mothers is now approaching the rate the Great Society purported to arrest in 1964, 40% or more. Will we be more successful at stopping this slide into broken or never formed families which we know are recipes for pervasive poverty? Will we recognize that it is the transfer of the responsibility of citizenship from citizens to their government that is the principal culprit in this? Decisions that should be made closest to the people who must live under the burden of their implementation whether that is monetary or undermining of civil liberties have been stolen, “outsourced” if you will to governments and their helpful agencies who rely on their helpful non-partisan institutions. This is government by expert and as we have already heard once tonight this is the exact opposite of what our forefathers fought a revolution for. Is this the best that we can do for our posterity? Let us pray that we can and must do better.

I started this talk tonight by promising to give you an honest accounting of the state of the union, well here it is. Entire generations of Americans have been educated to believe the contorted theories of madmen can be made to work, if we just give them enough time, surrender enough liberty and forego enough prosperity. We have accepted our ruling elites dictates that a constantly devalued paper currency is preferable to a stable one based on a stored supply of a commodity. This is how $11.79 earned by the young hero returning from World War 2 has the purchasing power of exactly $1.00 today what will happen when that number approaches .75 cents then .50?

Our state of the union must also take stock of our future economic capacity. This capacity can only be fueled by one thing: savings. Historically Americans have saved about 8.5% of their income today that number is 3%. These savings represent future capital to be invested in an economic “recovery” and looking at this number that recovery if it happens at all will be weak.

Our state of the union must take into account that more than 16 % of citizens are now relying on direct assistance from the government in the form of food stamps. Over 17% report being unemployed or under employed. Household debt ratios which had begun to decline have now begun to rise again as the average per card -credit card balance now exceeds $5,000. Now armed with these few statistics it is easy to see how a political class chosen from the same group of citizens is so susceptible to corruption and so ignorant of common sense virtues. In short, fellow citizen of these united states it is “We the People” who need to take that long, reflective look in the mirror while demanding our leaders do the same and even that isn’t enough. The tens of millions of customers this Leviathan has created for it’s own perpetuation cannot just simply revert back to a way of life with which they are unfamiliar and when the ability to borrow our way into the next iPhone expires what will they do then? I can’t answer that question but I can tell you this, it is not too late to begin to prepare the way for this inevitability.

Start by getting to know your mayor and the church leaders in your area. Your State Representatives and Senators should be on a first name basis with you too. Drag out a copy of your state constitution and read it, become familiar with it and treat it like the law of the land that it is. Begin to ask questions of these people, ask for their opinions of republicanism and where their first loyalties in government may lie. If they answer “to obey my oath to the Constitution” remind them that that requires not only following the lawful acts of Congress but also opposing with manly vigor those that are not within that bodies power. As one of the great Virginia republicans of the 1790’s, guided by Jefferson and Madison’s resolutions in Ky & VA said “If Congress can oppose state laws it deemed destructive of it’s existence then certainly sovereign states under the Constitution can do the same to preserve themselves.”

You may wonder where the rest of tonight’s State of the Union statistics are and I say to you that if I were to present you a litany of numbers and statistics on the financial and debt crisis these United States is facing it would obscure the message presented here but here’s the short version. We are broke and we are broke to the point that every spending decision we allow any elected leader to make today will have a direct, destructive influence on our posterity. This includes “spending” on national defense & “intelligence” which amounts to 48% of the entire planet’s military and intelligence spending. A great people lead by example not by use of force. George Washington went to his grave praying that his “farewell address” would have lasting impact and inform future generations that a free people only form friendships with other states and “tangling alliances with none”. This requires us to bring our troops home now, end our occupations of 139 countries around the world and eat some humble pie. I hear they are baking lots of it at Congressman Ron Paul’s house these days, why not pay him a visit and hear what he has to say.

Finally let me leave you with a positive thought that though this address was hastily cobbled together and contains a litany of problems to be addressed there remains one great thing going for us that others in our station in life didn’t have and that is a healthy love for liberty and deep abiding respect for the work of our forefathers. Those men fought a revolution meaning they were rolling the clock backwards 1 revolution to life as free people living under their English Constitution and colonies laws. That I believe is a good plan for what Thomas Paine called the “winter soldier” to set his or her sights on. If you are watching or listening to this then you my friend ARE that “winter soldier”. Their beau ideal of government was called “The Spirit of America … of ‘76” by the great Patrick Henry and borrowing a phrase from John F Kennedy, here is something I hope you can incorporate in what Washington called “this great work”.

Just 4 weeks after the “historic 2010 elections” this 111th Congress is poised to continue the tyranny they began in January of 2009. Let’s look at what’s on their short list:

•Raising the debt ceiling yet again

•Refusing to extend the Bush tax rates

•Refusing to repeal the new 1099 reporting rules for small business

•Extending unemployment benefits for yet another 2 years and borrowing the funds

•Passage of S 510 the Food Safety Modernization Act giving FDA police powers

This is on top of what these tyrants have already cast into stone - Nationalizing the Medical Industry with ObamaCare, the Car Industry by taking over Chrysler and GM, the banks with TARP, Financial Services with the Dodd/Frank Crime Family Bill and the list goes on and on. Folks, these madmen will never stop racking up legislative feathers for their Chairman Mao caps. They have to be stopped and in my estimation there remains only 2 ways to do it and before we get into them let me separate this discussion from yesterday’s post show. We restoring virtue in our private lives which will then carry over into our public lives, this may take a generation and though it must happen it won’t happen fast enough to save us from bankruptcy or outright despotism.

So the two choices are:
•Article V Amendment Convention

•Declarations of Independence
The first choice, an Article V Amendment Convention would work like this:

What an Art V could accomplish
Then we have choice number 2 which is more radical and that entails Declaring Independence as states again. First, we would have to convince enough fellow citizens that this would be the proper course and then we would have to elect, out of those same citizens, enough legislators to make this possible. Then there would need to be other states pursuing the same course so that a new union of states could be formed.

For arguments sake Florida, Louisiana, Mississippi, Alabama, Texas and both Dakotas could join with Nebraska, Kansas, Kentucky, Arizona, Arkansas, Montana and Oklahoma. These states could convene a new committee of correspondence, propose a convention and at that convention draft a Declaration of Independence borrowing heavily from Jefferson’s.

This new union can simply adopt the Original Constitution as its Supreme law and then as a condition of each state’s ratification, call for a new convention to propose amendments. It seems to me that this course may actually be preferable to a federal Article V convention because it allows culturally connected states to act immediately without permission or agreement by those whose culture runs counter. On the eve of the American Revolution, Charles Carroll of Carrollton wrote about continued usurpations of the English Constitution “[Because] unconstitutional powers [have been] exercised, the exercise doth not prove it right. Precedents drawn from the mere exercise of a disputed authority, so far from justifying the repeated exercise of that authority, suggest the strongest motive for resisting a similar attempt… since the acquiesence of the people under the exertion of a contested prerogative is now urged as proof of its legality.”
In other words, just because our Constitution has been killed by previous illegal acts, doesn’t make them right and doesn’t make them legitimate law.

On this Veterans Day - I simply say thank you.
For all of my blogging friends, please ck the follow couple of sites and say thank you. The guys deserve it!

My friend Kevin over at blogadelphia was a combat medic and continues in that field assisting those near the end of life. He is a good man. A single father who cares and provides a warm home for his children. A everyday hero, still.

A man that I am proud to call friend also is the guy behind the Blue Pit Bull. This guy served our country proudly and is still doing so, continuing his education and providing political thought and reason.

The next man is Billy Ray in Cowtown. This proud vet, served USMC 1967-71 Viet Nam 1968-69 . What else is there to say other than if you ck him out, you'll find a kind and gentle soul that loves life and his family. Something we all can strive for. He is the very definition of the American Hero.

El Gabacho is the man behind The Jarhead Manifesto. Simply call him Jar, yep you can tell buy that, he is an asset to us still. He can spin the daily grind into a smile. Another Ft. Worth boy that still call it home, he continues to root for the Frogs and doesn't pull punches with libs. He makes me laugh, he is Jar.

The next veteran, I have to say gives us an eye into the battle field that can only be known by those men and women who have donned the uniform. The words paint a canvas that compares to the many brush strokes of Van Gogh. The small details that combine to form a picture that draws emotional thought. This veteran is the Army of Dude.

To the countless of others whom I've missed and to my father, Thank You. You are our heroes, you are the best of us.

What Todays DeceptiCONS Can learn From 1798

OK, so we keep hearing all these hacks working in the punditocracy decrying Senator DeMint and Rand Paul for daring to talk about "principles" and then having the audacity to talk about RELYING ON THEM to make decisions.

Well, the DeceptiCONS and citizens of Libtardia have a lot to learn about history. Let me take you back to 1798, the year that Thomas Jefferson and James Madison teamed up to author the Virginia and Kentucky Resolutions.
These documents were a response to the overreach by the Adams Administration and Congress on the "Alien & Sedition Acts". A leader was needed to shepherd Jefferson's resolution through the Virginia Assembly and Jefferson chose John Taylor of Caroline for the task.

During the heat of debate and with 1798's version of DeceptiCONS arguing that with implied powers Congress could pretty much do whatever it wanted, Taylor stuck to the principle that the Constitution must be enforced against Congress BY the States. The reward for this action Taylor said, was written in a local newspaper:

"As to the clause giving Congress power to pass necessary laws for carrying delegated powers into effect, it created no new powers, but had reference to the powers already granted. The acceptance of the doctrine of implication would mean that "those great and inestimable rights which flow from Nature, and are the gift of Nature's God, will be assassinated by the rude and unfeeliing hand of ferocious despotism". Answering G. Taylor's argument that the power to pass laws relative to alien enemies was implied, he said that Congress had the express power to declare war, that as soon as war was declared, by the Law of nations, alien enemies became prisoners of war, and Congress could say what was to be done with them. And then, after a gloomy picture of all the departments of the government swallowed up in one, he exclaimed: "What, then, are the people to wait till the pressure of the evil principle is felt? No. As an elegant author expresses it, they augur misgovernment at a distance, and snuff the approach of tyranny in every tainted breeze... I have said and have quoted others, like Dr. Kevin Gutzman as saying that if Republicans do what we believe they were sent to do and that they MUST do.
Gutzman wrote recently "Lining out programs is both fiscally essential and, in light of the Tea Party phenomenon, politically necessary to Republicans. Constitutionally, Republicans are in the best position they can be in: they have control only of the chamber of Congress in which all spending bills must originate. So, Republicans, line out programs. Kill them. Tell the people why you’re doing it. Do it now. You will be rewarded. If the program doesn’t go through, blame Obama. It will be his fault. Your constituents will understand. You have power without responsibility, so take advantage of it."

Idea of a Perfect Commonwealth by David Hume (ca. 1754)

Scottish philosopher David Hume's essay entitled "Idea of a Perfect Commonwealth" is perhaps the greatest hallmark of promoting the ideas of "little-r" republicanism thus far gifted to humanity. While many of Mr. Hume's critics branded him a perpetual cynic for having little positive to say or faith in humanity, this essay spoke clearly to the cornerstone of private property rights, a decentralized government, and a hearty system of checks and balances which by his estimation were absolutely required were such a system to exist as more than passing fancy.

IDEA OF A PERFECT COMMONWEALTH

David Hume 1754

IT is not with forms of government, as with other artificial contrivances; where an old engine may be rejected, if we can discover another more accurate and commodious, or where trials may safely be made, even though the success be doubtful. An established government has an infinite advantage, by that very circumstance of its being established; the bulk of mankind being governed by authority, not reason, and never attributing authority to any thing that has not the recommendation of antiquity. To tamper, therefore, in this affair, or try experiments merely upon the credit of supposed argument and philosophy, can never be the part of a wise magistrate, who will bear a reverence to what carries the marks of age; and though he may attempt some improvements for the public good, yet will he adjust his innovations, as much as possible, to the ancient fabric, and preserve entire the chief pillars and supports of the constitution.
The mathematicians of Europe have been much divided concerning that figure of a ship, which is the most commodious for sailing; and Huygens, 1 who at last determined the controversy, is justly thought to have obliged the learned, as well as commercial world; though Columbus had sailed to America, and Sir Francis Drake made the tour of the world, 2 without any such discovery. As one form of government must be allowed more perfect than another, independent of the manners and humours of particular men; why may we not enquire what is the most perfect of all, though the common botched and inaccurate governments seem to serve the purposes of society, and though it be not so easy to establish a new system of government, as to build a vessel upon a new construction? The subject is surely the most worth curiosity of any the wit of man can possibly devise. And who knows, if this controversy were fixed by the universal consent of the wise and learned, but, in some future age, an opportunity might be afforded by reducing the theory to practice, either by a dissolution of some old government, or by the combination of men to form a new one, in some distant part of the world? In all cases, it must be advantageous to know what is most perfect in the kind, that we may be able to bring any real constitution or form of government as near it as possible, by such gentle alterations and innovations as may not give too great disturbance to society.

All I pretend to in the present essay is to revive this subject of speculation; and therefore I shall deliver my sentiments in as few words as possible. A long dissertation on that head would not, I apprehend, be very acceptable to the public, who will be apt to regard such disquisitions both as useless and chimerica
All plans of government, which suppose great reformation in the manners of mankind, are plainly imaginary. Of this nature, are the Republic of Plato, and the Utopia of Sir Thomas More. 3 The Oceana is the only valuable model of a commonwealth, that has yet been offered to the public. 4 The chief defects of the Oceana seem to be these. First, Its rotation is inconvenient, by throwing men, of whatever abilities, by intervals, out of public employments. Secondly, Its Agrarian is impracticable. Men will soon the art, which was practiced in ancient Rome, of concealing their possessions under other people's name; till at last, the abuse will become so common, that they will throw off even the appearance of restraint. Thirdly, The Oceana provides not a sufficient security for liberty, or the redress of grievances. The senate must propose, and the people consent; by which means, the senate does not have a negative upon the people, but, what is of much greater consequence, their negative goes before the votes of the people. Were the King's negative of the same nature in the English constitution, and could he prevent any bill from coming into parliament, he would be an absolute monarch. As his negative follows the votes of the houses, it is of little consequence: Such a difference is there in the manner of placing the same thing. When a popular bill has been debated in parliament, is brought to maturity, all its conveniencies and inconveniencies, weighed and balanced; if afterwards it be presented for the royal assent, few princes will venture to reject the unanimous desire of the people.
But could the King crush a disagreeable bill in embryo (as was the case, for some time, in the Scottish parliament, by means of the lords of the articles 5 ), the British government would have no balance, nor would grievances ever be redressed: And it is certain, that exorbitant power proceeds not, in any government, from new laws, so much as from neglecting to remedy the abuses, which frequently rise from the old ones. A government, says Machiavel, must often be brought back to its original principles.
6 It appears then, that, in the Oceana, the whole legislature may be said to rest in the senate; which Harrington would own to be an inconvenient form of government, especially after the Agrarian is abolished.
Here is a form of government, to which I cannot, in theory, discover any considerable objection.
Let Great Britain and Ireland, or any territory of equal extent, be divided into 100 counties, and each county into 100 parishes, making in all 10,000. If the country, proposed to be erected into a commonwealth be of more narrow extent, we may diminish the number of counties; but never bring them below thirty. If it be of greater extent, it were better to enlarge the parishes, or throw more parishes into a county, than increase the number of counties.
Let all the freeholders of twenty pounds a-year in the county, and all the householders worth 500 pounds in the town parishes, meet annually in the parish church, and chuse, by ballot, some freeholder of the county for their member, whom we shall call the county representative.
Let the 100 county representatives, two days after their election, meet in the county town, and chuse by ballot, from their own body, ten county magistrates, and one senator. There are, therefore, in the whole commonwealth, 100 senators, 1100 county magistrates, and 10,000 county representatives. For we shall bestow on all senators the authority of county magistrates, and on all county magistrates the authority of county representatives.
Let the senators meet in the capital, and be endowed with the whole executive power of the commonwealth; the power of peace and war, of giving orders to generals, admirals, and ambassadors, and, in short, all the prerogatives of a British King, except his negative.
Let the county representatives meet in their particular counties, and possess the whole legislative power of the commonwealth; the greater number of counties deciding the question; and where these are equal, let the senate have the casting vote.
Every new law must first be debated in the senate; and though rejected by it, if ten senators insist and protest, it must be sent down to the counties. The senate, if they please, may join to the copy of the law their reasons for receiving or rejecting it.
Because it would be troublesome to assemble all the county representatives for every trivial law, that may be requisite, the senate have their choice of sending down the law either to the county magistrates or county representatives.
The magistrates, though the law be referred to them, may, if they please, call the representatives, and submit the affair to their determination.
Whether the law be referred by the senate to the county magistrates or representatives, a copy of it, and of the senate's reasons, must be sent to every representative eight days before the day appointed for the assembling, in order to deliberate concerning it. And though the determination be, by the senate, referred to the magistrates, if five representatives of the county order the magistrates to assemble the whole court of representatives, and submit the affair to their determination, they must obey.
Either the county magistrates or representatives may give, to the senator of the county, the copy of a law to be proposed to the senate; and if five counties concur in the same order, the law, though refused by the senate, must come either to the county magistrates or representatives, as is contained in the order of the five counties.
Any twenty counties, by a vote either of their magistrates or representatives, may throw any man out of all public offices for a year. Thirty counties for three years.
The senate has a power of throwing out any member or number of members of its own body, not to be re-elected for that year. The senate cannot throw out twice in a year the senator of the same county.
The power of the old senate continues for three weeks after the annual election of the county representatives. Then all the new senators are shut up in a conclave, like the cardinals; and by an intricate ballot, such as that of Venice 7 or Malta, they chuse the following magistrates; a protector, who represents the dignity of the commonwealth, and presides in the senate; two secretaries of state; these six councils, a council of state, a council of religion and learning, a council of trade, a council of laws, a council of war, a council of the admiralty, each council consisting of five persons; together with six commissioners of the treasury and a first commissioner. All these must be senators. The senate also names all the ambassadors to foreign courts, who may either be senators or not.
The senate may continue any or all of these, but must re-elect them every year.
The protector and two secretaries have session and suffrage 8 in the council of state. The business of that council is all foreign politics. The council of state has session and suffrage in all other councils.
The council of religion and learning inspects the universities and clergy. That of trade inspects everything that may affect commerce. That of laws inspects all the abuses of law by the inferior magistrates, and examines what improvements may be made of the municipal law. That of war inspects the militia and its discipline, magazines, stores, &c. and when the republic is at war, examines into the proper orders of generals. The council of admiralty has the same power with regard to the navy, together with the nomination of the captains and all inferior officers.
None of these councils can give orders themselves, except where they receive such powers from the senate. In other cases, they must communicate every thing to the senate.
When the senate is under adjournment, any of the councils may assemble it before the day appointed for its meeting.
Besides these councils or courts, there is another called the court of competitors; which is thus constituted. If any candidates for the office of senator have more votes than a third of the representatives, that candidate, who has most votes, next to the senator elected, becomes incapable for one year of all public offices, even of being a magistrate or representative: But he takes his seat in the court of competitors. Here then is a court which may sometimes consist of a hundred members, sometimes have no members at all; and by that means, be for a year abolished.
The court of competitors has no power in the commonwealth. It has only the inspection of public accounts, and the accusing of any man before the senate. If the senate acquit him, the court of competitors may, if they please, appeal to the people, either magistrates or representatives. Upon that appeal, the magistrates or representatives meet on the day appointed by the court of competitors, and chuse in each county three persons, from which number every senator is excluded. These, to the number of 300, meet in the capital, and bring the person accused to a new trial.
The court of competitors may propose any law to the senate; and if refused, may appeal to the people, that is, to the magistrates or representatives, who examine it in their counties. Every senator, who is thrown out of the senate by a vote of the court, takes his seat in the court of competitors.
The senate possesses all the judicative authority of the house of Lords, that is, all the appeals from the inferior courts. It likewise appoints the Lord Chancellor, and all the officers of the law.
Every county is a kind of republic within itself, and the representatives may make bye-laws; which have no authority 'till three months after they are voted. A copy of the law is sent to the senate, and to every other county. The senate, or any single county, may, at any time, annul any bye-law of another county.
The representatives have all the authority of the British justices of peace in trials, commitments, &c.
The magistrates have the appointment of all the officers of the revenue in each county. All causes with regard to the revenue are carried ultimately by appeal before the magistrates. They pass the accounts of all the officers; but must have their own accounts examined and passed at the end of the year by the representatives.
The magistrates name rectors or ministers to all the parishes.
The Presbyterian government is established; and the highest ecclesiastical court is an assembly or synod of all the presbyters of the county. The magistrates may take any cause from this court, and determine it themselves.
The magistrates may try, and depose or suspend any presbyter.
The militia is established in imitation of that of Swisserland, which being well known, we shall not insist upon it. 9 It will only be proper to make this addition, that an army of 20,000 men be annually drawn out by rotation, paid and encamped during six weeks in summer; that the duty of a camp may not be altogether unknown.
The magistrates appoint all the colonels and downwards. The senate all upwards. During war, the general appoints the colonel and downwards, and his commission is good for a twelvemonth. But after that, it must be confirmed by the magistrates of the county, to which the regiment belongs. The magistrates may break any officer in the county regiment. And the senate may do the same to any officer in the service. If the magistrates do not think proper to confirm the general's choice, they may appoint another officer in the place of him they reject.
All crimes are tried within the county by the magistrates and a jury. But the senate can stop any trial, and bring it before themselves.

Any county may indict any man before the senate for any crime.

The protector, the two secretaries, the council of state, with any five or more that the senate appoints, are possessed, on extraordinary emergencies, of dictatorial power for six months.
The protector may pardon any person condemned by the inferior courts.

In time of war, no officer of the army that is in the field can have any civil office in the commonwealth.

The capital, which we shall call London, may be allowed four members in the senate. It may therefore be divided into four counties. The representatives of each of these chuse one senator, and ten magistrates. There are therefore in the city four senators, forty-four magistrates, and four hundred representatives. The magistrates have the same authority as in the counties. The representatives also have the same authority; but they never meet in one general court: They give their votes in their particular county, or division of hundreds.
When they enact any bye-law, the greater number of counties or divisions determines the matter. And where these are equal, the magistrates have the casting vote.

The magistrates chuse the mayor, sheriff, recorder, and other officers of the city.
In the commonwealth, no representative, magistrate, or senator, as such, has any salary. The protector, secretaries, councils, and ambassadors, have salaries.

The first year in every century is set apart for correcting all inequalities, which time may have produced in the representative. This must be done by the legislature.

The following political aphorisms may explain the reason for these orders.

The lower sort of people and small proprietors are good judges enough of one not very distant from them in rank or habitation; and therefore, in their parochial meetings, will probably chuse the best, or nearly the best representative: But they are wholly unfit for county-meetings, and for electing into the higher offices of the republic. Their ignorance gives the grandees an opportunity of deceiving them.

Ten thousand, even though they were not annually elected, are a basis large enough for any free government. It is true, the nobles in Poland are more than 10,000, and yet these oppress the people. But as power always continues there in the same persons and families, this makes them, in a manner, a different nation from the people. Besides the nobles are there united under a few heads of families.

All free governments must consist of two councils, a lesser and greater; in other words, of a senate and people. The people, as Harrington observes, 4 would want wisdom, without the senate: The senate, without the people, would want honesty.

A large assembly of 1000, for instance, to represent the people, if allowed to debate, would fall into disorder. If not allowed to debate, the senate has a negative upon them, and the worst kind of negative, that before resolution.

Cardinal de Retz says, 10 that all numerous assemblies, however composed, are mere mob, and swayed in their debates by the least motive. This we find confirmed by daily experience. When an absurdity strikes a member, he conveys it to his neighbor, and so on, till the whole be infected. Separate this great body, and though every member be only of middling sense, it is not probable, that any thing but reason can prevail over the whole. Influence and example being removed, good sense will always get the better of bad among a number of people.
There are two things to be guarded against in every senate: Its combination, and its division. Its combination is most dangerous. And against this inconvenience we have provided the following remedies. 1. The great dependence of the senators on the people by annual elections; and that not by an undistinguishing rabble, like the English electors, but by men of fortune and education. 2. The small power they are allowed. They have few offices to dispose of. Almost all are given by the magistrates in the counties. 3. The court of competitors, which must be composed of men that are their rivals, next to them in interest, and uneasy in their present situation, will be sure to take all advantages against them.

The division of the senate is prevented, 1. By the smallness of their number. 2. As faction supposes a combination in a separate interest, it is prevented by their dependence on the people. 3. They have a power of expelling any factious member. It is true, when another member of the same spirit comes from the county, they have no power of expelling him: Nor is it fit they should; for that shows the humour to be in the people, and may possibly arise from some ill conduct in public affairs. 4. Almost any man, in a senate so regularly chosen by the people, may be supposed fit for any civil office. It would be proper, therefore, for the senate to form some general resolutions with regard to the disposing of offices among the members: Which resolutions would not confine them in critical times, when extraordinary parts on the one hand, or extraordinary stupidity on the other, appears in any senator; but they would be sufficient to prevent intrigue and faction, by making the disposal of the offices a thing of course. For instance, let it be a resolution, That no shall enjoy any office, till he has sat four years in the senate: That, except ambassadors, no man shall be in office two years following: That no man shall attain the higher offices but through the lower: That no man shall be protector twice, &c. The senate of Venice governs themselves by such resolutions.

In foreign politics the interest of the senate can scarcely ever be divided from that of the people; and therefore it is fit to make the senate absolute with regard to them; otherwise there could be no secrecy or refined policy. Besides, without money no alliance can be executed; and the senate is still sufficiently dependant. Not to mention, that the legislative power being always superior to the executive, the magistrates or representatives may interpose whenever they think proper.

The chief support of the British government is the opposition of interests; but that, though in the main serviceable, breeds endless factions. In the foregoing plan, it does all the good without any of the harm. The competitors have no power of controlling the senate: They have only the power of accusing, and appealing to the people.

It is necessary, likewise, to prevent both combination and division in the thousand magistrates. This is done sufficiently by the separation of places and interests.

But lest that should not be sufficient, their dependence on the 10,000 for their elections, serves the same purpose.

Nor is that all: For the 10,000 may resume the power whenever they please; and not only when they all please, but when any five of a hundred please, which will happen upon the very first suspicion of a separate interest.

The 10,000 are two large a body either to unite or divide, except when they meet in one place, and fall under the guidance of ambitious leaders. Not to mention their annual election, by the whole body of the people, that are of any consideration.

Every county-law may be annulled either by the senate or another county; because that shows an opposition of interest: In which case no part ought to decide for itself. The matter must be referred to the whole, which will best determine what agrees with general interest.

As to the clergy and militia, the reasons of these orders are obvious. Without the dependence of the clergy on the civil magistrates, and without a militia, it is in vain to think that any free government will ever have security or stability.

In many governments, the inferior magistrates have no rewards but what arise from their ambition, vanity, or public spirit. The salaries of the French judges amount not to the interest of the sums they pay for their offices. The Dutch burgo-masters have little more immediate profit than the English justices of peace, or the members of the house of commons formerly. But lest any should suspect, that this would beget negligence in the administration (which is little to be feared, considering the natural ambition of mankind), let the magistrates have competent salaries. The senators have access to so many honourable and lucrative offices, that their attendance needs to be bought. There is little attendance required of the representatives.

That the foregoing plan of government is practicable, no one can doubt, who considers the resemblance that it bears to the commonwealth of the United Provinces, 11 a wise and renowned government. The alterations in the present scheme seem all evidently for the better.
1. The representation is more equal.
2. The unlimited power of the burgo-masters in the towns, which forms a perfect aristocracy in the Dutch commonwealth, is corrected by a well-tempered democracy, in giving to the people the annual election of the county representatives.
3. The negative, which every province and town has upon the whole body of the Dutch republic, with regard to alliances, peace and war, and the imposition of taxes, is here removed.
4. The counties, in the present plan, are not so independent of each other, nor do they form separate bodies so much as the seven provinces; where the jealousy and envy of the smaller provinces and towns against the greater, particularly Holland and Amsterdam, have frequently disturbed the government.
5. Larger powers, though of the safest kind, are intrusted to the senate than the States-General possess; by which means, the former may become more expeditious, and secret in their resolutions, than it is possible for the latter.

The chief alterations that could be made on the British government, in order to bring it to the most perfect model of limited monarchy, seem to be the following. First, The plan of Cromwell's parliament ought to be restored, by making the representation equal, and by allowing none to vote in the county elections who possesses not a property of 200 pounds value. Secondly, As such a house of Commons would be too weighty for a frail house of Lords, like the present, the Bishops and Scotch Peers ought to be removed: The number of the upper house ought to be raised to three or four hundred: Their seats not hereditary, but during life: They ought to have the election of their own members; and no commoner should be allowed to refuse a seat that was offered him. By this means the house of Lords would consist entirely of the men of chief credit, abilities, and interest in the nation; and every turbulent leader in the house of Commons might be taken off, and connected by interest with the house of Peers. Such an aristocracy would be an excellent barrier both to the monarchy and against it. At present, the balance of our government depends in some measure on the abilities and behaviour of the sovereign; which are variable and uncertain circumstances.

This plan of limited monarchy, however corrected, seems still liable to three great inconveniencies. First, It removes not entirely, though it may soften, the parties of court and country. Secondly, The king's personal character must still have great influence on the government. Thirdly, The sword is in the hands of a single person, who will always neglect to discipline the militia, in order to have a pretence for keeping up a standing army.

We will conclude this subject, with observing the falsehood of the common opinion, that no large state, such as France or Great Britain, could ever be modelled into a commonwealth, but that such a form of government can only take place in a city or small territory. The contrary seems probable. Though it is more difficult to form a republican government in an extensive country than in a city; there is more facility, once when it is formed, of preserving it steady and uniform, without tumult and faction. It is not easy, for the distant parts of a large state to combine in any plan of free government; but they easily conspire in the esteem and reverence for a single person, who, by means of this popular favour, may seize the power, and forcing the more obstinate to submit, may establish a monarchical government. On the other hand, a city readily concurs in the same notions of government, the natural equality of property favours liberty, and the nearness of habitation enables the citizens mutually to assist each other. Even under absolute princes, the subordinate government of cities is commonly republican; while that of counties and provinces is monarchical. But these same circumstances, which facilitate the erection of commonwealths in cities, render their constitution more frail and uncertain. Democracies are turbulent. For however the people may be separated or divided into small parties, either in their votes or elections; their near habitation in a city will always make the force of popular tides and currents very sensible. Aristocracies are better adapted for peace and order, and accordingly were most admired by ancient writers; but they are jealous and oppressive. In a large government, which is modelled with masterly skill, there is compass and room enough to refine the democracy, from the lower people, who may be admitted into the first elections or first concoction of the commonwealth. to the higher magistrates, who direct all the movements. At the same time, the parts are so distant and remote, that it is very difficult, either by intrigue, prejudice, or passion, to hurry them into any measures against the public interest.

It is needless to enquire, whether such a government would be immortal. I allow the justness of the poet's exclamation on the endless projects of human race, Man and for ever! 12 The world itself probably is not immortal. Such consuming plagues may arise as would leave even a perfect government a weak prey to its neighbors. We know not to what length enthusiasm, or other extraordinary movements of the human mind, may transport men, to the neglect of all order and public good. Where difference of interest is removed, whimsical and unaccountable factions often arise, from personal favour or enmity. Perhaps, rust may grow to the springs of the most accurate political machine, and disorder its motions. Lastly, extensive conquests, when pursued, must be the ruin of every free government; and of the more perfect governments sooner than the imperfect; because of the very advantages which the former possess above the latter. And though such a state ought to establish a fundamental law against conquests; yet republics have ambition as well as individuals, and present interest makes men forgetful of their posterity. The repudiation of Big Gubbmint is just that, the repudiation of this big multi-headed Hydra we call Leviathan. This is people standing up and saying, "We've had it with the taxing and spending into the nether regions of doom." It's no coincidence that people turn to politicians, government or manifestations of the state when looking for a positive outcome, yet the State has yet to deliver on this promise of Utopia while there are still some out there who seem to think there's the probability of a paradise on Earth.

Judgment Days: November 2 and 3

On November 2, the voters go to the polls. On November 3, the Federal Reserve goes to the mat.
On November 2, the voters will get to judge the United States Congress.
On November 3, the Federal Reserve gets to judge the Federal Reserve.

Most political commentators think the voters will turn thumbs-down on the Democrats. Most economic commentators thing the Federal Reserve will turn thumbs-down on the Federal Reserve.

November 2008 was the day of judgment for the Republicans. In October, the voters did not want the Big Bank Bailout. Congress ignored the voters and did what Hank Paulson and Ben Bernanke told them to do. The Republicans got tossed out a month later. They were in the majority, and they got blamed. The Democrats voted with the Republicans, but the Republicans were on duty, and they got hammered in November.

Meanwhile, the FED more than doubled the monetary base. The FED was panic city.

The Republicans then got two years to play spoilers. The Democrats had the votes to get the shovel-ready stimulus packages passed – larger than the Big Bank Bailout. They had the votes to get Obamacare passed. They had the votes to get the bank reform bill passed. The Republicans could vote no without fear of reprisals if these laws failed to restore the economy.

The economy is still on its back. The unemployment rate is not falling. The shovel-ready stimulus did not work. Nothing Congress has done has worked.

Nothing at the FED has worked, either.

So, the voters will gain vengeance on Democrats in Congress. But will the FED gain vengeance on the FED?

THE NOVEMBER SURPRISE

Everyone is waiting for the FED's November surprise. They are waiting for an announcement of a major new plan by the FED to print up hundreds of billions of dollars. This is "quantitative easing," also known as "Bernanke as a drunken sailor on a spree." So deeply Keynesian are the nation's financial analysts that they think this will be a great benefit to the economy.

There is much speculation – in both senses – regarding what the FED will buy. It can always buy Fannie Mae and Freddie Mac bonds. It has $1.2 trillion of these toxic assets on its books already. It can buy Treasury bonds. It can buy corporate bonds. It can buy short-term T-bills. It can buy Japanese bonds, Eurozone nations' bonds, or Chinese bonds.

What is not clear is this: Will the mere creation of fiat money change the lending decisions of the nation's commercial bankers? If they decide to increase their holdings of excess reserves at the FED, the shot in the arm will be ineffective.

This is the FED's great dilemma. If it adds greatly to the monetary base, this increased spending will not multiply through the fractional reserve process if commercial bankers decide that things are risky. Are things risky? Very.

We now have a new "gate" – foreclosuregate. The big banks have played fast and loose with the paperwork on loans and titles. It looks as though millions of home mortgages could not be successfully defended in a court of law, and even if they can be defended, the entire court system would shut down if every underwater mortgage debtor demanded to see the paperwork, which the lenders cannot supply. "I'll see you in court!" will cease to have any meaning. Hardly anyone will get into court.

Here's the problem. We have been trained to view the courts as a free resource. But when anything is free, it is rationed by standing in line. The courts cannot function, once millions of people say, "I'll see you in court."

Word is getting out that the lenders cannot prove that they possess valid title to the homes. This means that home owners cannot legally be evicted if they stop paying. They need only demand proof that the agency to which they are making payments holds title.

I wrote about this over a year ago. Now the day of reckoning is here. The escape route is becoming visible to underwater mortgage payers: "Stop paying until the lender can prove that he holds legal title." The lender must make property tax payments despite the nonpayment by home owners.

The best hope that the lenders have is the fear of foreclosure by the tax man. But if home owners pay their property taxes, this threat goes away. People can live rent-free except for paying property taxes. At some point – maybe soon – this is going to dawn on desperate, underwater debtors.

The dam looks like it is about to burst. The mainstream media are sensing that the illegally handled paperwork (digitswork) is a Huge Story, one that Americans will read about or watch on the Evening News. That means there will be added coverage. Then more people will find out.

In this psychological environment, is it likely that bankers will be ready to lend? If the answer is "no," then what good will the FED's pump priming do?

The FED can say whatever it likes. It can announce some program of currency expansion. It can dutifully explain why "this time, it's different." The investors may breathe a sigh of relief and buy something. But after the hoopla dies down, what will the bankers do with the increase in legal reserves? If the answer is "increase excess reserves," then the stimulus will have little effect in the overall economy.

At that point, the FED will be sitting a larger powder keg of legal reserves. This powder keg will attract the attention of currency speculators.

A FALLING DOLLAR

For a year, the FED has kept the monetary base stable. Nevertheless, the dollar has fallen in value internationally. There is no clear reason for this. We would think that a stable money policy would increase the international purchasing power of the dollar. It has in fact stopped domestic price inflation. The consumer price index is up only by 1% over the last 12 months. The rate of increase has fallen close to zero.

Internationally, the dollar has fallen. Domestically, the dollar has stabilized. What is going on here? The FED remains silent.

Here are my two cents' worth (declining internationally, stabilizing domestically): currency speculators look at the size of the Federal deficit and assume that the FED will be forced to buy Treasury debt eventually.

"Eventually" may begin on November 3. This is what the Establishment forecasters think is likely.

Bernanke has kept saying that the Federal Funds rate will stay low – the rate at which banks lend overnight money to each other. The FED is not keeping this rate low. It merely pretends to be keeping it low. What is keeping it low is the lack of demand for overnight money. Banks that have excess reserves at the FED do not need to borrow overnight money in order to meet their legal reserve requirements.

Let me quote the late, not great felon and former Attorney General John Mitchell: "Watch what we do, not what we say." Mitchell went to jail because someone inside the White House leaked copies of the tapes of what they had said. But Mitchell was correct. Watch what the FED does, not what it says. Then watch what commercial bankers do. They may counteract what Bernanke says he is doing and the FED actually does.

Talk is cheap. Actions count. There is way more to economic recovery than what Bernanke says and the FED does. Think "green shoots."

If, in the midst of a falling dollar internationally and stable prices domestically, the FED starts pumping, I think we can expect a falling dollar internationally. If the bankers do not lend, there will be low or no price inflation domestically. But international speculators will assess what the FED is doing and what commercial bankers are likely to do.

If they think that this new policy, if any, is likely to act as a catalyst for a recovery, they will sell the dollar. They will see that the enormous powder keg of legal reserves – the FED's monetary base – is subject to a fuse. If the FED lights this fuse with major purchases of any asset class, the bankers have the power to rip the fuse out of the powder keg. But if they decide to let it burn, there will be an explosion: M1 up, M1 multiplier up, excess reserves down. Then the era of price inflation will begin.

The FED cannot control what international currency speculators will do. If they sell the dollar, Geithner will have a problem.

The official Party Line at the Treasury is that a strong dollar is necessary. Geithner keeps saying this. He says that the yuan should be stronger, but no other currency. The dollar is the world's reserve currency. The Party Line has to be "strong dollar." The Treasury is meeting the deficit at low rates because of loans from Asian central banks. If these banks perceive that the new policy of the FED is to debase the currency, they may decide to stop buying T-bills. This is not assured, but it is a major risk.

If foreigners quit buying Treasury debt, the Treasury will have to sell its debt to Americans or to the FED. If it sells to the FED, then the crisis will escalate. The Treasury will absorb American investors' capital, and it will also be the unindicted co-conspirator of the FED.

BERNANKE'S MINE FIELD

The FED is in the crosshairs. This has never happened before. The swing voters are Tea Party people. They have heard the story of the Federal Reserve over the last two years. Bernanke is about to lead the Board of Governors across a political mine field.

The new Congress will not be ready to extend him a lot of credit. He may get some, but he will not get much. He had better be sure that any newly announced policy does not send up red flags between November 3 and January 2. A new era is coming – if not for the nation, then at least for the Federal Reserve System. Bernanke's days of wine and roses are also about to end.

The mainstream forecasters say that the FED will announce a major policy on November 3. Everyone expects an announcement of quantitative easing. But Bernanke will provide this. Yes, it is possible that the FED will begin a program of asset purchases, but Bernanke's words will be moderate and nonspecific. This man uses verbal chloroform the way that Greenspan used gibberish. If he were the head of the People's Bank of China, they would call him Lo-Kee.

If he is wise, he will tell the world that the Federal Open Market Committee will continue to monitor the situation closely. He will assure people that the Federal Funds rate will be kept close to zero percent for an indefinite future. He will say that there are signs of economic recovery, even though the rate of unemployment has remained higher than is consistent with long-term economic growth.

If he announces a major policy change, it will mean that he sees winter coming for all those green shoots. It will mean that Obama's stimulus has failed, that the shovels were not ready, and the FED's previous policies were insufficient to produce the promised economic recovery. Any major policy change will be a public announcement of failed programs, both by Congress and the FED.

If he says that it is time for a major policy change, this will be seen as a "Hail, Mary" pass. That is what quarterbacks use in the final minutes of a game in which the score is 13 to 7 against them. Bernanke threw one in late 2008: the more than doubling of the monetary base. But he said nothing. He was mute in September and October of 2009. Paulson did all the talking. When Bernanke bothered to show up, he was Paulson's potted plant.

If he makes a statement of a major change of policy, and then describes this policy, this will be the first time in his career at the FED in which he did either. This man hides behind a Maginot Line of footnotes in order to avoid committing to anything, other than maintaining the FedFunds rate close to zero percent, which the FED does not actually do.

If he says anything big, this will send a signal to international currency speculators: "Gentlemen, start your engines. Sell the dollar short."

Why would he do this? Why would he risk making a major announcement on the day after the elections?

This country will be facing two years of political gridlock. The Republicans will start holding hearings on anything the White House has done that will get air time. The drip-drip-drip of subpoenas will begin in January, and they will not stop.

Why would an announcement from Bernanke that he and his colleagues will begin a program mass inflation win him support in Congress? If he does this, he is dumber than a Dave Barry comparison of dumbness. He will give the new Republican majority in the House two months to prepare their questions for him.

The boiling economic issue today is the mortgage market and the banks. If he thinks that what the Congressional Republicans are waiting for is a policy of mass inflation, then his political instincts are even worse than his Keynesian tool kit, which is saying something.

Right now, he is safe. The mortgage fraud issue is not perceived as his fault. He came into office in February 2006. By that time, the housing bubble had begun to peak. No one has blamed him for Greenspan's bubble. He has been given a free pass. He needed it.

If he announces a policy of quantitative easing on the day after the elections, he will face a boiling pot of tea poured into his lap. Paul Krugman will applaud on November 4, but how many votes will Krugman have in the House on January 2?

CONCLUSION

If Bernanke announces a new policy of quantitative easing on November 3, he will light the fuse. It is a monetary fuse. It is also a political fuse.

What's in it for him, other than grief?
If he does this, he had better offer a clear statement – from Bernanke? – about exactly why the FED's policies have failed for two years, and why the new policy will get those green shoots growing. Otherwise, he will not be walking into a mine field; he will be running into it.

The violence of public passion is quite as likely to be in the direction of oppression as in any other; and the necessity of bills of rights in our fundamental laws lies mainly in the danger that the legislature will be influenced by temporary excitements and passions among the people to adopt oppressive enactments.

What a court is to do, therefore, is to declare the law as written, leaving it to the people themselves to make such changes as new circumstances may require. The meaning of the constitution is fixed when it is adopted, and it is not different at any subsequent time when a court has occasion to pass upon it."

Much has been made about the “Tea Party” movement and other American’s calls to “return to the Constitution” and get “our government back” from the politicians and special interests that have stolen it. There are many thoughtful plans being promoted that should the Republican Party regain control of the House of Representatives, they should pursue. These plans offer various degrees of remodeling the federal system but do nothing to alter its inexorable course toward either an Oligarchy or acting national democratic legislature.

Mike Church offers as a counterpoint this brief list of actions that would merely begin the process of “returning to the Constitution”. The list could easily number in the hundreds of pages and resemble one of the current Congress's legislative acts in both size and scope and even that wouldn’t completely “return us to the Constitution.”

I would like to take a moment to apologise to my followers and occasional readers. Over the last few weeks I have been distracted from this blog and other activities.

Starting around a year ago my best friend had a bout with the bottle that brought his world to crumble around him. I drove over a two hundred miles a day to be with him during his rehab. A few months back he caved. And thirty days has passed since I last saw him. We never went a day without seeing or at least speaking. Now, we never will again.
Damon -- I'm mad as hell at you, but you will always know - I love you.

Another friend, passed from this world Friday morning. Bill Arnett, aka - poacher. Poacher was a true character of the old world. Toughest man I've ever known. He once hit a deer on his motorcycle, crawled a half mile home on a gravel road and sewed his busted head back together. We found his bike the next day, then found him. God, he was lucky just to survive the wreck. He never went to the Doc for "attention" -- as he would say. Well lack of that "attention" caught up to him. And caught up with a vengeance. Three wks ago, he was bit by some sort of spider on his foot. It swelled to the point he wanted a wheel chair. A friend that he called, was bringing it to him. Less than 12 hours later, the friend, knocked and yelled, called and then busted in Poacher's door. In his bed he lie. A single gun shot to the head. I guess the pain was to much. Or maybe the infection had made him mad. He had lost three toes and the skin had split multiple times. Should get the results back from Dallas today.
Poacher -- I will always remember your warm smile and that hint of gentle craziness in your eye.

At his living wake, he said something that will live within me forever, " Wherever you are , reach out and talk to the guy next to you, we all need that. To be talked with. You'll never know what a few kind words and laughs will do for someone. After all, that is how we met."

It is precarious times for the upstart grassroots movement known as the Tea Party. The loose coalition made up of disparate groups including social conservatives, Ron Paul rEVOLutionaries, and some antiwar classical liberals peppered in, must be willing to look itself in the mirror and answer some critical philosophical inconsistencies, lest it go the way of all burgeoning movements of the past, ergo the proverbial flash in the pan.

The resistance by some, mainly the soft neoconservative entrants who exhibit an almost allergic reaction when it comes to discussing foreign policy or the parrot victory of merely installing so-called “conservative” federal justices, must confront their cognitive dissonance on appropriations otherwise all momentum gained thus far will be for naught. Therefore, those who chant, “Reduce spending” however still think invading Iraq, drone bombings in Pakistan, and lap up Bill Krystal’s saber rattling on Iran, must come to grips with the reality.

Whereby, if the movement is indeed sincere when it comes to the ever-ballooning debt and trillions more in deficit spending, an integral part of reducing the size of government is moored to a humble foreign policy as envisioned by the Founding Generation as its cornerstone, lest it be merely more emotionally charged, but philosophically vacant rhetoric. Shall we be Patriots or Nationalists?

So let me get back to the overriding point that you need to repeat. It’s not the difference between Republican policy and Democrat policy. It is the fact that policy exists where there is no need for policy. In other words, most of these things don’t need government, and they don’t need meddling from bureaucrats, from agencies, from Congress, from the Senate, from your state legislature, and on and on and on. But we are taught to believe that, “Well, how can an economy function without a government to run it?” Bingo. It is the thesis, it is the idea of central planning, central economic planning as what’s being discussed here. And it is the folly, the absolute fallacy that our destinies are controlled, I mean, folks, just think about this for just a second. Google this. Get your Google Earth maps out there. Let’s say you live in some part of Arizona. Let’s just say Tempe, Arizona just to throw a name out there. How far away is that from Mordor? Seriously, as the crow flies? How many miles is that? 2,000? 2,100? 2,200? You want to Google Earth that for me and give me a measure? It doesn’t really matter what it is. It won’t change the argument.

The point is, let me see if I understand this right. The daily execution and joy of your life must be approved, must be micromanaged, must be regulated, must be made better, must be made whole, must be made — oh, wait, it’s got to be for the good of the country. Why can’t it be for the good of Arizona? Why is this point so hard to grasp? Why can’t things that are good for the city of Tempe, Arizona not be good for the rest of the republic? If Tempe, Arizona is minding its own business, not causing wars, not stealing from their neighbors, living the good life, abiding by law, not over-managing or over-regulating their business and industry, and is cranking out goods and products and services that people want to buy, and is employing people, is doing things that happen in a free society in a free market, what threat are they to people in Bangor, Maine, other than, why, we don’t want to have to compete with them? Oh, so what do you do then? You buy a politician. But isn’t it true that rising tides lift all boats? Well, then, why wouldn’t you want — how many counties are in this republic? Is there a count of that? Can you see if you can get me a count of that? I’m curious.

Let’s just say for argument’s sake there’s 10,000 counties. Wouldn’t it better for 10,000 counties to be pursuing their own individual prosperity, their own individual excellence? And even when it applies to things like education and competing against one another inside — state to state, county to county? Wouldn’t that yield a better result than having a one-size-fits-all, dumbed-down edict from some central planning authority that must take into consideration the lowest common denominator in all equations, and must make all policies that descend from that equally applicable to all the counties and all the people in them? So you can’t strive for excellence because you’ve got to tell the people that are really good, look, you’re just going to have to hold hands and sing the Coke song and suck it up, bud. Yeah, we know you’re good at making jobs. We know you’re good at making movies or books or steel or whatever. But you’re going to have to make it, and you’re going to have to give some of what you make away because there are people out there that suck. There are people out there that aren’t good at what they do.

I mean, I’m just revulsed to the fiber and core of my being at what passes for our allegedly adult policy or our allegedly adult issue-oriented conversations in the state of our — why, we’ve got to get serious about this. We’re not serious about it. If we were serious about it, we would seriously be talking about breaking away and asking for a divorce from this monster. That would signal that you’re serious. Anything else, folks, this is just a circus. You’re participating in a circus. You’re participating in the idea that salvation comes from Washington. And you’re participating in the idea that that central authority is something that ought to be preserved. Can somebody explain to me outside, outside of the alleged need for common defense, why we must preserve that monster in its current form as our boss, as our capital? I mean, seriously, where is the adult logic and reasoning and discussion about this? Isn’t it high time that that idea be on the table?

Because before there was a welfare state, we didn’t have this collective notion that we put our prayer rugs out and bow down to Mordor on the Potomac every day and look for guidance on entitlements, and look for guidance on President Barack Obama — count how many times Jon Belmont on the nationwide broadcast ABC News says “President Barack Obama is out touring the country today, promoting the economy.” This hasn’t worked anywhere where it’s been tried. Why are we so foolish, and why aren’t people literally questioning the existence of that capital, and the existence, the authority of its power is beyond I.

Can you imagine the competition for industry, the competition for education and educators, the competition for anything that you can imagine that would happen, and that we would enjoy the fruits of, if all 3,140 counties out there were competing against one another? If they didn’t have Mordor on the Potomac? If they didn’t have a central planning authority to try to level the playing field and make it equal, equal, equal and even for everyone. Can you imagine? This is what Jefferson believed. This is what Jefferson spent his life defending. This is what the founders thought, or the founding generation thought that they had achieved for us and for posterity at the end of what was known as the Revolutionary War. They already had it, but they thought they had preserved it. Well, we in our daily lives and the things we do every day have lost sight and lost track of that. There is no salvation. And just to give you an indication of the extent to which the current constitutional culture in the United States has given centralizers like Pelosi and Obama, that is, people who want the federal government to have authority over everything you do, every minute of your life, how they have gotten what they want through a “we’ll never amend the Constitution to correct what the Congress is doing” attitude among conservatives, let me read for you a little bit of the appendix to Milton Friedman’s “Free to Choose.”

Milton Friedman was the leading advocate of liberty in American economics in the 20th Century. Now, I myself am not at root a Monetarist. I mean, people who are expert in economics know that he was also the leader of what was called the Monetarist school of economics. And I think he was mistaken at root about that. But the bottom line is Milton Friedman was a very prominent libertarian in the 20th Century, somebody who stood for freedom.

And he had a bestselling book, coauthored with his wife Rose in I think 1978, called “Free to Choose.” It was a number one bestseller for months and months. And in the appendix to that book, Friedman reprinted the Socialist Party platform of 1928. And the reason why he reprinted the Socialist Party platform of 1928 was to show us that by 1978 we were living with the Socialist Party platform of 1928. That is, every single element of it has been adopted.
So plank one in the Socialist Party platform of 1928, “Nationalization of our natural resources, beginning with the coal mines and water sites, particularly of Boulder Dam and Muscle Shoals.” And then in parentheses he says “Boulder Dam, renamed Hoover Dam, and Muscle Shoals are now both federal projects.”

Number two, “A publicly owned giant power system under which the federal government shall cooperate with the states and municipalities in the distribution of electrical energy to the people at cost.” And in parentheses he says, “We’ve made a regional start on this with the Tennessee Valley Authority.” There’s actually more to it now than there was in 1978.

But anyway, number three, “National ownership in democratic management of railroads and other means of transportation and communication.” Parentheses, “Railroad passenger service is completely nationalized through Amtrak. Some freight service is nationalized through Conrail. The FCC controls communications by telephone, telegraph, radio, and television.” And of course what Friedman didn’t know in 1978 was that now the federal government feels free to wiretap millions, literally millions of Americans, without ever identifying them, without ever getting a warrant from any kind of a judge. It’s even more problematic than it was when Friedman wrote this.

Number four, Socialist Party platform of 1928, “An adequate national program for flood control, flood relief, reforestation, irrigation, and reclamation.” Well, Friedman in parentheses says, “Government expenditures for these purposes are currently in the many billions of dollars.” And of course they’re far greater now than they were when he wrote that. I mean, I could go through the rest of this platform from the Socialist Party of 1928. But my point is, for those of you who don't think the Red vs Blue, Yankee vs the Red Sox idea is dangerous because we’ll lose the republic that the founding fathers bequeathed us, wake up.

So the bottom line is people commonly object to the idea of, oh, lord, the socialists will get control of the government. The idea that the federal Constitution is doing what it’s supposed to do, that it’s performing its only function, which is to limit the power of people in federal office, is absurd.

Federal judges and the Congress have completely remade it so that the other day, when Pelosi was asked where do you get authority to tell people who their doctor will be, she laughed because it assumed, you know, the question had underlining it the idea that there was something illegitimate about the way federal officials have been behaving since 1937. Well, of course, as you and I know, there is something illegitimate about the way that federal officials have been behaving since 1937.

So the question remains -- what are you going to do about it?

Beck to Tea-Party: Stop Displays of Individual Expression, You Must Conform so GOP may Assimilate Movement

CEDAR LAKE, INDIANA - Despite an ever-growing list of establishment Republicans defeated by grassroots tea-party candidates tired of government as usual from either party, Glenn Beck issued an edict on high Tuesday evening that the individual expression seen at most tea party protests must cease.

He specifically targeted a Chairman MAObama t-shirt designed by Mike Church as an example of individuals refusing to conform to "proper" decorum, as well as those who dress as the Statue of Liberty, or scribble kitsch signs with a sharpie, postulating such spontaneous displays must halt if the Tea Party is to be taken seriously.

Instead, the man who supported the Imperial Invasion of Iraq, the PATRIOT Act, referred to the then fledgling movement as a “Domestic Threat” in 2007, supports a European-style VAT tax, and supported the first Stimulus bill calling it “necessary” envisions a mass of sheep marching in unified suit, tie, and ballroom gown conformity, forwarding his brand of statism.

Further, this from the man who admits he does not check facts, has been caught lying repeatedly, and held an “Honor” rally on the steps of the biggest advocate for total intervention by the federal government in U.S. History, i.e. Abraham Lincoln. My how convenient that a philosophy catalyzed in 2007 and forwarded by Dr. Ron Paul for over 30 years, who of course Mr. Beck still derides as a "kook" in matters of foreign policy, now seeks to self-anoint himself Czar of the movement he once reviled when it was the talking-point philosophy of the moment.

Therefore, we might do well to pay close attention to those who pretend to support liberty solely as a scheme to buttress their ratings such as Glenn Beck; as opposed to true patriots like Mike Church who advocated liberty, Austrian economies, and a non-interventionist foreign policy, at times when doing such was still unpopular and not beneficial to ratings whatsoever.

My preference shall forever remain loyal to principled individuals like Dr. Ron Paul, Mr. Rockwell, and Mr. Church as opposed to a vain & aspiring man who designs to elevate himself to the highest seat in the freedom movement.

This week was one of those moments in life where it dawns on you that, wait a minute, something is afoot here. Wait a minute, something is going on that shouldn’t be going on, hasn’t been going on, isn’t supposed to go on. The establishment nut jobs, those that have had a stranglehold – let’s just go back to the start here for a second, quickly. It was six weeks ago or so when Angelo M. Codevilla released that brilliant essay in the American Spectator magazine about the ruling class, America’s ruling class and how they can be defeated. And a lot of us took to it. A lot of us read it. I can tell you personally that certain scholars read it and applauded it, without getting into any names. I know they read it because I sent it to them. And what Mr. Codevilla had done is he had divided the us-es and the thems for the first time in a long time. And he divided the us-es and thems into two groups: the ruling class, which is the Mike Castles, which is the Karl Roves, which is the DeceptiCon and Libtardia establishment; and the rest of us, which he called the “country class.” Well, the country class struck back. This week the country class struck a blow.

You know, here’s what’s happening out there. Here’s what’s happening. Now, this is the most amazing thing, and this is what ought to have you members of Libtardia scared to death. You’d better start making your plans to travel to Canada. You liberty-hating, big government-embracing fools better make your plans to go live somewhere else because you’re not welcome here anymore, brother and sister. Your days of spending my money are coming to a close. Your days of spending OP's (other peoples) money are coming to a close. Your days of ordering us about and telling us what we’re going to eat, Michelle Obama, are coming to a close. You’re finished. You’re through. I want you off this campus by 9:00 o’clock Monday morning. Just threw a little “Animal House” in there.

Here’s what’s happening. Inside the hated by the establishment media, academia, and in most parts, let’s just be honest here, libertarian movement, liberty movement, the Republican Party, it’s not very well liked. It’s looked down upon with scorn. They’re the party of big government, just like the Democrats. They’re the party of war. They’re the party of tax breaks, but only for those – or tax cuts, but only for those qualified and what have you. They grew government at a faster clip than the Democrats before them. They’re not very well liked. But there is an apparatus in place. There is a national apparatus in place that is almost impossible to duplicate. And what you’re seeing happening here is that the actual conservatives, most of you people, and those that call themselves conservatives, limited government types, that you are instructing your party bosses that they’re fired. You’re telling the Karl Roves, you’re telling the Mitch McConnells, you’re telling the Bob Bennetts, you’re telling the Bob Dole types, you’re telling the George W. Bushes, you’re fired. We’re not going to do it your way anymore. We will take you over and beat you from within.

I don’t think that the establishment types have quite gotten a grasp on what’s afoot here, and that is that they have – what was that movie with Ryan O’Neal and, oh, it was a World War – oh, “A Bridge Too Far.” Anybody remember “A Bridge Too Far”? They have gone a government program, they have gone a tax increase too far. They have grown Leviathan to the point where it’s so in the faces of people that people must make a choice. And you can’t choose just to be a little bit against government. You can’t choose just to be a little opposed to Big Brother. It’s all or nothing.

And many of you out there are warming to this idea, as well, because I can tell you, because I read your emails, I hear your phone calls, I watch your blog posts and what have you. And I’ve seen, just as I’ve seen myself grow more and more alienated, even from the idea of government intervention and the idea of government running this and the idea of politicians doling out favors and controlling what are supposed to be free markets, which are a laughing stock. They’re not even close to being free markets. It is an insult to that entity known as a free market to even call what we have in the United States a free market. Will Glenn Beck Kill the Tea Party?

Glenn Beck is better than most syndicated talk show hosts. While right-wing radio mainstays Rush Limbaugh and Sean Hannity offer little more than Republican talking points, Beck regularly eschews such hackery, instead warning of the "progressivism" that exists in both parties or the perils of blind partisanship.

It's hard to fathom Limbaugh or Hannity saying what Beck did at CPAC this year: "I have not heard the people in the Republican Party yet admit they have a problem ... I don't know what they stand for anymore." But after his Restoring Honor rally, I'm not quite sure what Beck thinks the Tea Party should stand for anymore either.

At the Restoring Honor rally, estimates of around 100,000 Tea Party types gathered in Washington, D.C., on Aug. 28 to accomplish — well, no one really knows what. Conservative darling Sarah Palin said a whole lot of nothing, as did Beck and a slew of other hosts who seemed genuinely excited that so many people could come together even if none of them really seemed to know why.

Much like Obama's promises of "hope" and "change," the platitudes offered at Beck's event were equally as empty, making it more like a right-wing Woodstock. The New York Times Ross Douthat aptly described why those who attended found it so groovy: "Americans love leaders who seem to validate their way of life ... The Obama campaign raised it to an art form, convincing voters that by merely supporting his candidacy, they were proving themselves cosmopolitan and young-at-heart, multicultural and hip. In a sense, Beck's Restoring Honor was like an Obama rally through the looking glass. It was a long festival of affirmation for middle-class white Christians — square, earnest, patriotic, and religious."

Identity politics have always been a part of the Tea Party. The Left perceives this as racist while many on the Right think it's refreshing. The idea of so many middle-class whites, many of them Christians and traditional Republicans, coming together en masse to question their party and re-examine first principles, is a liberating concept. It's also long overdue. After decades of empty promises from politicians and the cyclical rants of talk radio hosts, it seemed like the Right's grassroots supporters were finally ticked off enough to demand results, roll some heads, and "take their country back" while focusing sharply on impending economic doom for our country.

As is always the case with populism, any real movement is naturally going to be made up of real people, some of whom might hold wacky signs or become obsessed with trivial conspiracies. That Beck himself has behaved oddly or embraced certain conspiracy theories has always been less important than his willingness to encourage and aid the Tea Party in general, corralling the masses in the Right direction and demanding that they keep an eye on the big government wings of both parties. So long as anti-government sentiment was the overriding Tea Party narrative, it remained healthy, and so long as Beck's trivial preoccupations remained such, it was tolerable, becoming little more than irrelevant fodder for the Left.

So what in God's name was the purpose of the Promise Keepers-light event Beck held on Aug. 28? It would be one thing if it were simply another trivial distraction, but the overt religiosity on display at the Restoring Honor rally could spell certain doom for a grassroots movement with the potential to unite more Americans against government spending than the Tea Party's harshest critics are willing to admit.

Independents and disaffected Democrats, atheists and agnostics, Christians, Jews, Muslims, and virtually every political, religious, or cultural category imaginable could feasibly unite under a fiscal restraint-minded Tea Party banner. But some new Moral Majority? The moment religion becomes an explicit part of the Tea Party platform — and Beck's rally was certainly heading in that direction — it severely limits the movement's primary goal of eliminating government and debt.

A movement born of identity politics, at least in part, must mature philosophically if it wishes to become serious in its limited-government desires. Beck's rally actually caused me to question the Tea Party's seriousness. By further embracing identity politics — which is exactly what Beck's rally did — the Tea Party took a step in the wrong direction precisely because identity politics are a throwback to the same old partisanship that has historically comforted conservatives while government continues to grow.

This writer has never had a problem with an influential pundit like Beck being all over the place politically so long as he generally ended up in the right place. But unfortunately, with his Restoring Honor rally, Glenn Beck was closer to taking the Tea Party back to the George W. Bush years than toward a constitutional revival.

There is NO Free Market under the FEDERAL RESERVE System

The mantra of "America is a capitalism with a free-market" is utterly false and has been so, since 1913 upon the creation of the private FEDERAL RESERVE system which turned the economy over lock, stock, and FIAT over to a private cadre of Central Bankers. Whether in the form of mandates to the auto manufacturers, health care providers, education loans, flood insurance, or passenger train service, the federal government through a system of corporatist-negotiated regulation has wholly removed both competition and choice from Americans.

So when you hear that we need to get back to a free market economy – you must understand, there has been no free market economy. It’s always been a managed and mangled economy, ever since the creation of that beast, the Federal Reserve; ever since Franklin Delano Roosevelt set the ABC agency into motion, and we had to live our lives by the credo and by the orders, issues, and edicts of so-called experts.I would like to have the choice to buy a brand new vehicle that costs less than $10,000; wouldn’t you? Wouldn’t you? Wouldn’t that be nice? I would like to be able to decide whether or not I want an airbag. I would like to be able to decide whether or not I want the, oh, you’re an idiot, and you can’t drive this car, I’m going to lock the steering wheel until you put your foot on the brake features. I would like to be able to purchase an automobile that just starts and gets me from point A to point B. If I want to add features and luxuries, then I may do so, in a real free market. This is a fantasy. I don’t want to buy a new car.Why do you want to pay for government-mandated crap? Drive the car you have until the transmission falls out of it.

One final nail in your DeceptiCon, fake, phony, fantasy, free market economy world, doubting Thomases and Janes. One final nail: Name the last independent American auto maker that brought a vehicle to market. And for extra credit, tell me what the federal government did to that man, and what happened to him. Hmm? Great story. Somebody ought to make a movie about it.

Let me give you another example of how the government, of how the state has surreptitiously, and without you even noticing, taken over your – taken over popular culture and polluted your brain. By show of hands, how many of you remember the great private eye TV series of the 1970s and early 1980s?

Well, here’s taking my hat off to Tom Selleck in “Magnum P.I.” Was he a G-Man? No. He worked for Higgins. How about Jim Rockford, “Rockford Files”? Remember that? Greatest detective that ever lived, James Garner. Please show for me, if you will, the private industry portion of law enforcement that is on network television today. They’re all G-Men. Whoa, we got “CSI: NY.” We got “CSI: Miami.” We got “Law & Order.” We got every cop, every army, every fed, every agency. Oh, they’re the greatest. Jack Bauer. We have no Jim Rockford. What the hell happened to my “Rockford Files”? The state has taken over. The state rules your mind. You don’t even think about – what the hell’s a private detective? Who’s that? Well, we don’t need them anymore. Just like the state took over the orphanages and all the charities and made them all nice and comfy little 501(c)3s. Oh, that’s right, that’s right, we’ve nationalized charity while we nationalized everything else. And you didn’t even notice it. Where’s Jim Rockford? Where’s “Magnum P.I.”? Hmm? Where’s “Simon & Simon”? And the list could go on. I could sit here from now until tomorrow morning and rip off the names of great private detectives, private. What’s that word ‘private’? Yeah, what is that?

It’s what critical thinking requires you to do. This line that we’re being fed, and this culture and this reality that we’re being asked to accept, it’s like having that thing in the “Matrix” movies plugged into the back of your head. It’s not reality. It’s all manufactured. Comfortably manufactured, I might add.
And Jim Garner, the guy that played Jim Rockford, is the biggest lib there is. Doesn’t matter. I never knew that when I was a little boy watching “The Rockford Files.” Never missed an episode.
“Starsky & Hutch.” Wait, Starsky and Hutch were cops, weren’t they? They were undercover.

When the Fed was given power that is not constitutionally granted, and when Congress abdicated its power and abdicated its responsibility to coin the money and to regulate the value thereof, and allows instead a board of central bankers in cahoots with central bankers across the world to do so, that was what precipitated all of this. You can’t go off and fund and fight a war with no end if you don’t have a printing press to print the money, inflate the currency, and destroy the wealth of the people to do it. Do you think, if George W. Bush had gone to Congress and gotten a declaration of war against Iraqin 2002 and had said, look, this is going to cost — what’s the figure today? What is it, $789 billion is the price tag for the Iraq war? Do I have that right?

It’s less than the porkulus succubus stimulus. But do you think that if Bush had gone and said we’re going to have this declaration of war, and we’re going to have to have an income surtax that every American is going to have to pay, and it’s going to be, oh, I don’t know, $200 a month or whatever the figure would be, that today in 2010 there wouldn’t be a revolt to not pay it anymore? The only reason that they can do it the way they do it now is because they have the Federal Reserve to print the money — fake, phony, fiat currency that’s not worth the paper it’s printed on. Oh, it’s backed up by securities that are borrowed from the Chinese and whoever. But they can only run — “they” being the federal government — can only run deficits because they have their own printing press.

If you eliminate the printing press, well, then you eliminate their access to all this fake, phony money. That’s why Ron Paul’s book, “End the Fed,” is so powerful, why it’s so feared. And this is why the DeceptiCon Republican establishment doesn’t — they can’t accept him. You people have got to understand this. He must be a pariah. He has to be. You cannot accept the Jeffersonian, Ron Paul vision inside today’s Republican Party because it means your party is over, too.

Now, let me demonstrate DeceptiCons to you. What’s a DeceptiCon? A DeceptiCon is a fake, phony, fraud of a conservative.

Now, you’re going to read — oh, you’re all about electing Republicans because you want to repeal ObamaCare. Have you made it loud and clear to guys like Rubio, DeceptiCons like Rubio and the rest of them, that you don’t want the central planning statist control that’s going to be replacing it from Republicans, too? Or am I reading the Tea Party tea leaves wrongly? Is it that the Tea Party just doesn’t want Obama and Pelosi to wield the power to control your healthcare, how it’s paid for, how it’s delivered; but you’re perfectly comfortable with Boehner & Co., and Scott Brown. Well, Marco Rubio is going to be their little understudy. So here’s Rubio telling you exactly what your precious GOP majority is going to do, which is going to be centrally plan the economy with capital R’s instead of capital D’s.

Marco Rubio: "And, finally, we must repeal ObamaCare and replace it with a plan that will lower health insurance costs for Americans without bankrupting the nation, replace it with a system that promotes competition, allows people to keep the coverage they already have, and gives individuals the same tax breaks that businesses get when they buy healthcare insurance for their employees."

Now, if you’re saying — “He’s trying to win a seat in Congress” That was the weekly GOP response to the Democrat radio address. That was the voice of the Republican Party there. That was not Rubio. That was Rubio taking his marching orders from Olympia Snowejob and Susan Collins. Now, look. And I hate to throw names out there and demonize, or I don’t want to vilify people that are not here to defend themselves. So let me just make it a blanket accusation. They’re all saying the same thing.

When I say “they,” well, if you work for Fox News, if you work for the Clinton News Network, if you work for Freedom Works, if you work for any of these television shows or these Tea Party groups and what have you, they’re all saying, “Well, we can’t — we just can’t cut the spigot off. It’s not humane to cut people off of federal assistance.” Oh, but it’s humane to let them stay on it and compel the rest of us to pay for it. That’s humane. So I’ve got to be robbed at gunpoint from the IRS tax collector so that the humane thing, which is taking money that I have earned through my own damn hard work, can be given to someone that hasn’t earned it. Oh, that’s humane? I’m sorry, my friend, but my definition and your definition of humane are two different things, existing on two totally separate universes, for crying out loud. What’s humane about that?

The humane thing is to give a man a fish, and then you’ll teach him how to eat. But teach a man how to fish, and he’ll feed himself for the rest of his life. I think some wiseguy named Jesus Christ said that. I mean, this is just so — we can’t cut people off. Like hell we can’t cut them off. Are we serving the cause of humanity by continuing to subsidize the sloth and the laziness and the teaching of dishonor? That’s the humane thing to do, to teach people that their lot in life is contingent upon someone else going out and earning for them? Are you freaking kidding me? We used to have a word for that, Will. You know what the word was? It’s called “slavery.” Well, I ain’t your slave, Daddy.

His closing monologue, his little commentary, basically said yesterday that why aren’t we more like Germany? What has Germany done? Germany decided that they were not going to participate in the bailout. They did not stimulate their economy by borrowing money. Instead, they cut back on the amount of unemployment their unemployed could get. They cut some taxes. They cut actual German government spending. And here they are with their unemployment rate sinking, and that’s a good thing, like a rock to the bottom of the employment pool. This is a good thing. Germany is on the ascendancy. Their GDP grew some monstrous amount in the last quarter, something like 9.7 percent, after they pursued their austerity measures. But what are we doing? Oh, no, we’ve got to be Greece. The “little r” republican path back to the Constitution for the 112th Congress

Narrative- Much has been made about the “Tea Party” movement and other American’s calls to “return to the Constitution” and get “our government back” from the politicians and special interests that have stolen it. There are many thoughtful plans being promoted that should the Republican Party regain control of the House of Representatives, they should pursue. These plans offer various degrees of remodeling the federal system but do nothing to alter its inexorable course toward either an Oligarchy or acting national democratic legislature.

I offer as a counterpoint this brief list of actions that would merely begin the process of “returning to the Constitution”. The list could easily number in the hundreds of pages and resemble one of the current Congress's legislative acts in both size and scope and even that wouldn’t completely “return us to the Constitution.”

With an open mind and with an even more hopeful heart I offer this brief set of actions that would only begin the “return” process and challenge my fellow citizens to consider the magnitude of what must be done to “secure the [former] blessing of liberty to ourselves AND our posterity.

Authors Disclaimer - I make no claim to the precise naming of all agencies, Acts and or laws cited herein.

1. Freeze all federal hiring, this includes funding requests from the executive branch to hire.

2. Repeal the Budget Act of 1974 and all it’s contingent COLA “mandates” no matter the agency or program they are applicable to.

3. Freeze under threat of rescinding funding any and all new regulations currently under review or consideration

4. Have an up or down vote on a Declaration of War with Iraq and with Afghanistan. if either fails then troop withdrawals must begin immediately.

5. Pass the Private Property Restoration Act which among other things shall forbid any federal magistrate from hearing any cases to restrict use of private property.

6. Repeal the AMT permanently by statute.

7. Repeal the capital gains tax.

8. Refuse to fund the Education Department and the Department of Energy, any programs, grants projects or construction begun under these agencies must cease. The EPA’s charter must be rewritten to make it clear that it only has jurisdiction over federal and or territorial waters and land.

9. Repeal ObamaCare and all contingent legislation. Congress must then use legitimate Commerce Clause powers to “make commerce regular” and remove from the tax code all subsidies, all claims of tax credit, any and all restrictions federal law imposes on the sale or use of major medical health insurance. This must include federal recognition of PPO, HMO or other plans created to satisfy Congress.

10. Repeal the FICA and sunset the program by Jan 1, 2030. Establish a cutoff date for continued payment eligibility such as born on or before December 31, 1959.

11. Repeal the Patriot Act of 2001, 2005 and sunset the Department of Homeland Security on or before December 31, 2012.

12. Repeal all mandates, taxes and law pertaining to the SCHIP program.

13. Announce the return of U.S. Gold and Silver bullion coins as legal tender and order the treasury to begin the purchase of bullion with the intent of eliminating paper currency in favor of gold and silver coin and gold and silver coin backed notes.

14. Pass the Debt Consolidation and Repayment Act. This Act will require the sale of all lands currently “owned” by the U.S. government which do not house “needful buildings, docks, arsenals, forts and magazines”. This is not limited to “Parks” and “National forests”. All proceeds are to be solely applicable to the repayment of the U.S. Governments outstanding debts both domestic and foreign.

15. End the federal tax designations enacted and known as 501 (c), (g), 503, 527 e.g. “non-profits”.

16. Repeal the “Income tax witholding act” and enact an immediate and deduction free, flat income tax law, payable once per year by each citizen.

17. Repeal all corporate and business interest, income and profit taxation.

18. Heed the call of 38 states that shall call an convention to amend the Constitution under Article V of the U.S. Constitution.

A Mexican family of six, all welfare recipients and gang members lived on the first floor, they died.
